Abstract
Pada skripsi ini, penulis mengangkat permasalahan Batasan Ultra petita dalam Petitum Ex Aequo Et Bono. Tema tersebut dilatarbelakangi oleh adanya asas ultra petita atau ultra petitum partium non cognoscitur atau menjatuhkan putusan atas hal-hal yang tidak diminta lebih dari yang digugat. Larangan ultra petita secara limitatif hanya ada dalam ranah hukum perdata berdasarkan pasal 178 ayat (3) HIR dan Pasal 67 huruf c Undang-undang nomor 14 tahun 1986 tentang Mahkamah Agung. Namun dalam perkembangan hukum di Indonesia, mulai banyak putusan-putusan perdata yang menyimpangi asas ultra petita demi keadilan terutama dalam putusan yang mengabulkan petitum subsidair Ex aequo et bono baik itu putusan pengadilan tingkat pertama hingga putusan kasasi Mahkamah Agung. Berdasarkan permasalahan tersebut, penulis membahas rumusan masalah “Apa batasan ultra petita terhadap petitum Ex aequo et bono “ Penulisan karya tulis ini menggunakan metode penelitian yuridis normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach). Bahan hukum yang digunakan diperoleh melalui studi kepustakaan dan dianalisis dengan teknik analisis deskriptif untuk memperoleh norma atau dasar hukumnya dan penerapan kaidah-kaidah hukum tersebut serta telaah terhadap bahan hukum sekunder berupa buku dan jurnal untuk memperoleh doktrin-doktrin ilmu hukum dari para ahli. Dari hasil penelitian tersebut, penulis memperoleh jawaban bahwa penyimpangan terhadap asas ultra petita diperbolehkan dengan menerapkan beberapa batasan yaitu batasan yurisprudensi dan batasan hukum
English Abstract
In this thesis, the author raises the issue of Ultra petita Limitations in Civil Cases. This theme is motivated by the ultra petita principle or making decisions on things that are not requested or granting more than what is being sued. The limitative ultra petita prohibition only exists in the realm of civil law based on Article 178 paragraph (3) of the HIR and Article 67 point c of Law Number 14 of 1986 concerning the Supreme Court. However, in the development of law in Indonesia, there are many civil decisions that deviate from the ultra petita principle for the sake of justice, especially in the decision that grants the subsidiary petitum Ex aequo et bono, both first-level court decisions and Supreme Court cassation decisions. Based on these problems, the author discusses the formulation of the problem "What is the ultra petita limit of a decision on the petitum Ex aequo et bono " The writing of this paper uses a normative juridical research method with a statute approach and a case approach. The legal materials used were obtained through a literature study and analyzed using descriptive analysis techniques to obtain the norms or legal basis and the application of these legal rules as well as a study of secondary legal materials in the form of books and journals to obtain legal science doctrines from experts. From the results of this study, the authors obtain the answer that deviations from the ultra petita principle are allowed by applying several limitations, namely jurisprudence limit and legal limits.
