Abstract
Pada skripsi ini penulis mengangkat permasalahan mengenai penyitaan akun media sosial sebagai alat bukti dalam persidangan dalam perspektif hukum acara pidana Indonesia, tema tersebut dilatarbelakangi oleh perbedaan terkait benda apa yang disita oleh penyidik dan juga bagaimana menampilkannya di persidangan sebagai alat bukti ketika kasusnya berada di media sosial. Terkait perbedaan mengenai benda yang disita tersebut, dapat berpotensi melanggar hak–hak dari pihak yang disita, dikarenakan ketika akun tersebut disita oleh penyidik, didalamnya terdapat pesan–pesan yang bersifat pribadi, kontrak kerja, dan lain-lain yang tidak berkaitan dengan tindak pidana yang dilakukan. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah:(1) Bagaimana implikasi yuridis pengaturan penyitaan terkait alat bukti yang menggunakan akun media sosial? (2) Bagaimana kekuatan pembuktian alat bukti akun media sosial di persidangan? Kemudian penulisan karya tulis ini menggunakan metode yuridis normatif dengan metode pendekatan perundang undangan (statue approach) dan pendekatan kasus (case approach). Bahan hukum yang diperoleh penulis akan dianalisis dengan menggunakan teknik analisis deskriptif analitis, dengan mendeskripsikan suatu bentuk peraturan perundang undangan kemudian membandingkannya dengan peristiwa nyata terjadi di lapangan, lalu penulis juga menggunakan penafsiran gramatikal dan sistematis. Dari hasil penelitian dengan metode diatas, penulis memperoleh jawaban atas permasalahan bahwasanya di Indonesia, khususnya hukum acara, prosedur atau mekanisme penyitaan akun media sosial sebagai bukti digital masih belum efektif. Karena belum adanya regulasi yang mengatur khusus terkait prosedur tindakan penyitaan yang berimplikasi kepada pelanggaran hak–hak tersangka/terdakwa, dan juga berindikkasi kepada tindakan abuse to power oleh penyidik ketika menyita akun media sosial. Ketika di persidangan, masih perbedaan cara menampilkan bukti digital, ada yang memakai flashdisk yang berisi tangkapan layar terkait dugaan tindak pidana, ada pula yang menampilkan akun media sosial nya. Karena adanya dualisme pandangan kedudukan alat bukti elektronik, akun media x sosial ini dapat menjadi alat bukti yang berdiri sendiri menurut Undang–Undang ITE, ataupun juga alat bukti perluasan yang sudah ada di KUHAP.
English Abstract
In this thesis the author raises the issue of seizure of a social media accounts as a digital evidence in court from the perspective of criminal code procedure Indonesia, the theme is motivated by differences regarding what objects are seizured by investigators and also how to display them in court as evidence when the case is on social media acacount. Regarding the differences regarding the seizured objects, it could potentially violate the rights of the seizured party, because when the account was seizured by investigators, it contained personal message, contract of works, and others that were not related to the crime. Based on the above, this paper raises the formulation of the problem: (1) What are the juridical implications of seizure arrangements related to evidence using social media accounts? (2) What is the strength of proof of digital evidence on social media accounts in court? Then the writing of this paper uses a normative juridical method with a statue approach and a case approach. The legal material obtained by the author will be analyzed using descriptive analytical analysis techniques, by describing a form of legislation and then comparing it with real events occurring in the field, then the author also uses grammatical and systematic interpretation. From the results of the research using the above method, the authors get answers to the problem that in Indonesia, especially procedural law, procedures or mechanisms for seizure of social media accounts as digital evidence are still not effective. Because there are no regulations that specifically regulate the procedure for seizure actions which have implications for the violation of the rights of the suspect/defendant, and also indicate abuse to power by investigators when seizuring social media accounts. When at the court, were still differences in the way to display digital evidence, some used flash drives containing screenshots related to alleged criminal acts, some displayed their social media accounts.
