Abstract

Dalam skripsi ini penulis mengangkat permasalahan mengenai perizinan Pendirian Pom Elektrik Melalui Sistem OSS yang mana hingga saat ini belum diketahui masyarakat umum. Yang melatarbelakangi penelitian tersebut yaitu hingga saat ini maraknya usaha pom mini di kota Malang yang mana usaha tersebut tidak memiliki legalitas dikarenakan masyarakat belum mengurus perizinan tersebut. Berdasarkan pemaparan permasalahan diatas, rumusan masalah yang diangkat penulis yaitu: 1. Bagaimana implementasi pasal 167 Peraturan Pemerintah Nomor 5 Tahun 2021 Tentang Penyelenggaraan Perizinan Berusaha Berbasis Risiko Terhadap Perizinan Pendirian Pom Mini (Elektrik) Melalui Sistem OSS di Kota Malang? 2. Apa saja hambatan yang terjadi dalam penerapan sistem OSS di kota malang terkait Perizinan Pendirian Pom Mini (Elektrik) 3. Bagaimana upaya yang telah dilakukan oleh Pemerintah Daerah Kota Malang dalam mengatasi Masalah tersebut. Terkait menjawab permasalahan diatas, penulis menggunakan jenis penelitian Yuridis Empiris, metode pendekatan yang digunakan adalah Yuridis Sosiologis, jenis dan sumber data terbagi menjadi jenis, sumber primer dan sekunder, teknik yang digunakan dalam memperoleh data adalah wawancara dan studi kepustakaan, dan teknik analisis data penelitian ini menggunakan teknik deskripstif kualitatif. Berdasarkan hasil penelitian yang mana sesuai dengan rumusan masalah serta metode penelitian diatas, penulis menemukan jawaban permasalahan bahwa hingga saat ini masyarakat kota Malang belum mengetahui adanya OSS tersebut dikarenakan tidak adanya sosialisasi dari pemerintah kota setempat, sedangkan dari pihak x pemerintah sendiri masih belum mengetahui tupoksi tugas masing-masing dinas setempat.

English Abstract

In this thesis, the author raises the issue of licensing the establishment of an Electric Pom through the OSS system, which until now civil has not known. The background of this research is now the rise of (Electric) mini petrol station businesses in Malang, where these businesses do not have legality because the community has not taken care of the licensing. Based on the explanation of the problems above, the formulation of the problems raised by the author is 1. How is the implementation of Article 167 Paragraph (3) Letter F of Government Regulation Number 5 of 2021 concerning Administration of Risk-based Business Permit regarding Permit required to establish (Electric) Mini Petrol Station via OSS System in Malang City? 2. What are the obstacles that occur in the implementation of the OSS system in the city of Malang related to the Licensing of Establishment of (Electric) Mini Petrol Station 3. What are the efforts that have been made by the Local Government of Malang City in overcoming this problem? The author used the type of empirical juridical research to answer the problems. The approach used is sociological juridical, the types and sources of data were divided into types, primary and secondary sources, the techniques used in obtaining data are interviews and library studies, and research data analysis techniques. This study used a qualitative descriptive approach. Based on the results of the study were per the formulation of the problem and the research method above, the author found the answer to the problem that the people xii of Malang do not know about the OSS because there is no socialization from the local city government, while the government itself still does not know the main tasks of each-each local office
