Abstract
Peraturan daerah merupakan bagian dari pelaksanaan prinsip negara hukum dalam UUDNRI 1945. Pembentukan Peraturan Daerah dalam Undang-Undang Nomor 12 Tahun 2011 dan perubahannya dalam Undang-Undang Nomor 5 Tahun 2019 memberikan hak partisipasi masyarakat dalam pembentukannya. Partisipasi masyarakat dalam pembentukan daerah harus dibentuk dengan memperhatikan prinsip transparansi dan partisipatif, dalam membentuk model partisipasi yang memenuhi prinsip tersebut tulisan ini melakukan analisa perbandingan model partisipasi dalam pembentukan hukum dengan beberapa negara Bosnia and Herzegovina, Hungaria, Afrika Selatan, dan Finlandia. Perbandingan ditujukan untuk membentuk konsep partisipasi masyarakat yang partisipatif, transparan dan menekankan posisi masyarakat sebagai mitra pemerintah sebagai manifestasi “citizen power”. Konsep partisipasi meliputi partisipasi dalam pra-legislasi, legislasi, dan evaluasi.
English Abstract
Local regulations are part of the enforcement of the state principle of the 1945 Indonesian Constitution. Establishment of Local Regulations in Law Number 12 of 2011 and its amendment in Law Number 5 of 2019 governs the right of the people to participate in the establishment. The encouragement of the participation should take into account transparency and participative principle. To find out more regarding this issue, this research also analysed the comparison between the model of participation involved in the establishment of law and that in several countries like Bosnia, Herzegovina, Hungary, South Africa, and Finland. This comparative approach is intended to form the concept of participation of people that is transparent and to emphasise the position of the people as government’s partners as a manifestation of “citizen power”.
