Abstract

Penelitian ini membahas mengenai urgensi dari pembentukan Majelis Kode Etik Guru yang memberikan perlindungan hukum bagi profesi guru serta batasan sanksi fisik yang diperbolehkan dalam pendidikan agar tidak terkualifikasi tindak pidana penganiayaan. Hal ini dilatar belakangi karena terdapat banyak kasus guru yang dilaporkan ke polisi karena telah memberikan sanksi fisik kepada peserta didiknya, sehingga diduga telah melakukan tindak pidana penganiayaan terhadap peserta didik tersebut. Dari hal tersebut kemudian diperlukan bentuk perlindungan hukum yang konkrit bagi guru serta batasan yang jelas dalam pemberian sanksi fisik bagi peserta didik. Hasil dari penelitian ini menunjukkan bahwa Majelis Kode Etik perlu dibentuk demi terciptanya perlindungan hukum bagi profesi guru serta untuk menghindari penggunaan sanksi pidana dalam penyelesaian perkara dugaan tindak pidana penganiayaan oleh guru ini, selain itu pemberian sanksi fisik oleh guru kepada peserta didiknya dibatasi dengan adanya beberapa peraturan yaitu Peraturan Menteri Pendidikan dan Kebudayaan Nomor 82 Tahun 2015 tentang Pencegahan dan Penanggulangan Tindak Kekerasan di Lingkungan Satuan Pendidikan, Pedoman Kerja antara POLRI dan PGRI, Nomor: B/53/XII/2012 Nomor: 1003/UM/PB/XX/2012 tentang Mekanisme Penganganan Perkara dan Pengamanan Terhadap Profesi Guru, dan kode etik profesi guru itu sendiri.

English Abstract

This research discusses the urgency of the establishment of teacher’s code of ethical assemblies that provide legal protection for the teaching profession and the limitation of physical sanctions allowed in education not to be qualified into a criminal act of persecution. This is because there are many cases on teachers reported to the police because they have given physical sanctions to students, so it is suspected that they have committed a crime of persecution to the student. So then a concrete legal protection for teachers and a clear limitation on physical sanctions to students is totally required. The results of the research show that the code of ethical assemblies needs to be established in order to create legal protection for teachers and can avoid criminal sanctions while resolving the case. In addition, the physical sanction by teachers to the students is limited by the existence of several regulations, that is the Minister of Education and Culture Regulation No. 82 of 2015 on the Prevention and Countermeasures of Violence in Education Unit Environment, Working Guidelines between POLRI and PGRI Number: B / 53 / XII / 2012 Number: 1003 / UM / PB / XX / 2012 concerning Case Handling Mechanism and Security of Teacher Profession, and the code of professional profession itself.
