Abstract

Peraturan daerah merupakan bentuk hukum yang tertulis yang berisi aturan tingkah laku yang bersifat mengikat secara umum dan di dalam masyarakat daerah peraturan daerah dibentuk dengan tujuan mengatur masyarakat daerah secara umum agar dapat berperilaku sesuai dengan apa yang diharapkan agar dapat mendukung penyelenggaraan pemerintahan dan pembangunan. Materi muatan yang terdapat pada peraturan daerah tingkat provinsi maupun kabupaten/kota diatur dalam pasal 236 ayat (3) Undang-Undang Republik Indonesia Nomor 23 tahun 2014 tentang Pemerintahan Daerah bahwasanya materi muatan peraturan daerah adalah seluruh materi muatan dalam rangka penyelenggaraan otonomi daerah dan tugas pembantuan serta penjabaran lebih lanjut ketentuan peraturan perundang-undangan yang lebih tinggi. Gubernur memiliki dua jenis pengawasan yaitu pengawasan preventif dan represif. Dalam upaya preventif gubernur melakukan pengawasan terhadap sebuah rancangan peraturan daerah kabupaten/kota yang mengatur tentang RPJPD, RPJMD, APBD, perubahan APBD, pertanggungjawaban pelaksanaan APBD, pajak daerah, retribusi daerah, dan tata ruang daerah. Kemudian dalam upaya represif Gubernur dapat melakukan klarifikasi terhadap keseluruhan peraturan daerah kabupaten/kota yang dianggap tidak sesuai dengan peraturan perundang- undangan diatasnya, kepentingan umum dan kesusilaan. Undang-Undang Republik Indonesia Nomor 23 Tahun 2014 tentang Pemerintahan Daerah Pasal 91 ayat (3) huruf a disebutkan bahwa gubernur dalam melaksanakan tugas sebagai wakil pemerintah pusat mempunyai wewenang membatalkan peraturan daerah kabupaten/kota dan peraturan Bupati/walikota. Selanjutnya kewenangan gubernur membatalkan perda kabupaten/kota diatur dalam pasal 251 ayat (2), (3), (4) dan (8). Berdasarkan Putusan Mahkamah Konstitusi Nomor: 137/PUU-XIII/2015 kewenangan gubernur membatalkan peraturan daerah kabupaten/Kota telah dibatalkan sehingga gubernur sudah tidak dapat lagi membatalkan peraturan daerah kabupaten kota. Namun dibatalkannya kewenangan gubernur membatalkan peraturan daerah kabupaten/kota tersebut tidak dibarengi dengan pembatalan gubernur sebagai wakil pemerintah pusat yang teradapat pasal 91 ayat (3) huruf a, sehingga hal ini menimbulkan ketidakjelasan dalam hal dihapusnya kewenangan gubernur dalam pembatalan perda kabupaten/kota yang diatur dalam pasal 251 dengan kewenangan gubernur yang diatur dalam pasal 91 ayat (3) huruf a Undang-Undang Republik Indonesia Nomor 23 tahun 2014 tentang Pemerintahan Daerah. Apa dasar pertimbangan hakim Mahkamah Konstitusi dalam membatalkan pasal 251 ayat (2), ayat (3), ayat (4) dan ayat (8) Undang-Undang Republik Indonesia Nomor 23 Tahun 2014? Bagaimana implikasi hukum putusan Mahkamah Konstitusi Nomor: 137/PUU- XIII/2015 terhadap kewenangan gubernur dalam membatalkan Peraturan daerah Kabupaten/Kota dalam Undang-Undang Republik Indonesia Nomor 23 Tahun 2014? Metode penelitian yang digunakan dalam penulisan tesis ini adalah yuridis iv normative dengan menggunakan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus Tesis ini menjelaskan Dаsаr pertimbаngаn hаkim Mаhkаmаh Konstitusi dаlаm membаtаlkаn Pаsаl 251 аyаt (2), аyаt (3), аyаt (4) dаn аyаt (8) аdаlаh: Prinsip Negаrа Kesаtuаn Republik Indonesiа (NKRI), prinsip otonomi dаerаh dаn desentrаlisаsi, sertа Prinsip kekuаsааn kehаkimаn dаn negаrа hukum. Selаin itu jugа mempertimbаngkаn permаsаlаhаn konstitusionаlitаs kewenаngаn pembаtаlаn perаturаn dаerаh kаbupаten/kotа. Kemudian Implikаsi hukum putusаn Mаhkаmаh Konstitusi Nomor: 137/PUU-XIII/2015 terhаdаp kewenаngаn gubernur dаlаm membаtаlkаn Perаturаn dаerаh kаbupаten/Kotа dаlаm Undаng-Undаng Republik Indonesiа Nomor 23 Tаhun 2014 аdаlаh sebаgаi berikut: Pertama, Berаkhirnyа duаlisme pengujiаn perаturаn dаerаh yаng selаmа ini terjаdi аntаrа pemerintаh dengаn Mаhkаmаh Аgung. Kedua, Tidаk berdаyа gunаnyа pаsаl 91 аyаt (3) huruf а terkаit Gubernur sebаgаi Wаkil Pemerintаh pusаt yаng mempunyаi wewenаng membаtаlkаn Perаturаn dаerаh Kаbupаten/kotа kаrenа pаsаl tersebut tidаk berfungsi kаrenа kewenаngаn Gubernur membаtаlkаn perdа pаdа pаsаl 251 sudаh dihаpus melаlui Putusаn Mаhkаmаh Konstitusi Nomor: 137/PUU-XIII/2015

English Abstract

Regional regulation is a written law consisting of conduct which is binding in general. Regional regulation is made to manage regional societies in order to behave as expected to further support the governance and development. Material content in regional regulation either in the province or regency/municipality was regulated in Article 236 Paragraph (3) of Law of the Republic of Indonesia Number 23 of 2014 on Regional Government regarding the fact that material content of regional regulation covers all material content in terms of the execution of regional autonomy and co-administration work and further explanation on the provision of higher Laws. The Law of the Republic of Indonesia Number 23 of 2014 on Regional Government Article 91 of Paragraph (3) letter a states that governor, required to execute tasks as a representative of central government, holds authority to annul regional regulation of Regency/Municipality and Regent Regulation/Mayor Regulation. Furthermore, the authority of Governor to annul regional government of Regency/ Municipality is regulated in Article 251 Paragraph (2), (3), (4), and (8). According to the Decision by Constitutional Court Number 137/PUU- XIII/2015, the authority of governor to annul regional regulation of Regency/Municipality is cancelled, thus the governor has no more authority to annul regional regulation of regency and municipality. However, the cancellation of the authority of the governor in terms of the annulment of regional government of regency/ municipality was not accompanied by the cancellation of governor as the representative of central government as regulated in Article 91 Paragraph (3) letter a. This triggers confusion in terms of the abolishment of authority of the governor to annul regional regulation of Regency/Municipality regulated in vi Article 251 with the authority of the governor as regulated in Article 91 Paragraph (3) letter a of Law of the Republic of Indonesia Number 23 of 2014 on Regional Government. What is the basic consideration of the judges in Constitutional Court in terms of annulling Article 251 Paragraph (2), (3), (4), and (8) of Law of the Republic of Indonesia Number 23 of 2014? What is the legal implication of the Decision of Constitutional Court Number 137/PUU-XIII/2015 on the authority of governor in annulling the regional regulation of Regency/Municipality in Law of the Republic of Indonesia Number 23 of 2014? The research method employed in this thesis involved normative juridical method with statute, conceptual, and case approach. The basic consideration of judges of Constitutional Court regarding the annulment of Article 251 Paragraph (2), (3), (4), and (8) comprises: Unified States of the Republic of Indonesia (NKRI), regional autonomy principle, and decentralisation, and judicial power principle, and state of law. In addition, issue related to constitutionality of the annulment of regional regulation of Regency/Municipality is also considered. The legal implication of governor of the Decision of Constitutional Court Number 137/PUU-XIII/2015 toward the authority of governor in terms of annulling regional regulation of Regency/ Municipality in the Law of the Republic of Indonesia Number 23 of 2014 is as follow: First, the dualism of the examination of regional regulation that has occurred between government and Supreme Court is put to an end. Secondly, the lack of essence of Article 91 Paragraph (3) letter a related to the governor as the representative of central government that is authorised to annul regional regulation of the Regency/Municipality because the Article has not functioned well since the authority of government to annul regional regulation in Article 251 has been abolished according to the Decision of Constitutional Court Number 137/PUU-XIII/2015
