Abstract
Pada penelitian ini penulis mengangkat isu hukum mengenai kedudukan kekebalan perwakilan diplomatik Uni Eropa dalam perspektif hukum internasional. Uniknya posisi serta kedudukan Uni Eropa sebagai salah satu organisasi internasional mengenai urusan diplomatik Uni Eropa menjadi dasar ketertarikan penulis untuk melakukan penelitian terkait hal ini. Penulis mengangkat dua rumusan masalah, pertama, bagaimana kedudukan para perwakilan organisasi internasional khususnya UE dan perwakilan diplomatik negara berdasarkan perspektif hukum internasional? Kedua, bagaimana hak kekebalan dan keistimewaan yang diberikan kepada perwakilan UE dengan perwakilan dari negara berdasarkan dasar hukumnya masing-masing, apakah perwakilan UE menikmati kekebalan yang sama seperti perwakilan diplomatik negara. Penelitian skripsi ini menggunakan metode penelitian yuridis-normatif serta menggunakan pendekatan perundang – undangan, konseptual, dan kasus. Teknik analisis yang digunakan dalam penelitian ini adalah interpretasi gramatikal dan sistematis. Dari hasil penelitian dan analisis sesuai dengan metode di atas, maka peneliti menyimpulkan bahwa untuk kedudukannya sendiri Uni Eropa memiliki kedudukan dimata hukum internasional, dan mengenai hak kekebalan dan keistimewaan, tidak memiliki perbedaan yang signifikan, tetapi untuk masalah konsuler, Uni Eropa tidak mencantumkan di dasar hukumnya terkait hal terseebut. Dan hal ini menyulitkan Uni Eropa untuk mengimplementasikan perwakilan mereka dalam skala Internasional.
English Abstract
In this study, the author raises legal issues regarding the position of European Union diplomatic representatives in the perspective of international law. The unique position and position of the European Union as one of the international organizations regarding the diplomatic affairs of the European Union. The author raises two problem formulations, first, what is the position of representatives of international organizations, especially the EU and diplomatic representatives of countries based on the perspective of international law? Second, what are the rights of immunities and privileges granted to representatives of international organizations with representatives from countries based on their respective legal bases? This thesis research uses a juridical-normative research method and uses a statutory, conceptual, and case approach. The analytical technique used in this research is grammatical and systematic interpretation. From the results of the research and analysis in accordance with the above method, the researcher concludes that for its own position the European Union has a position in the eyes of international law, and regarding the rights of immunities and privileges, there is no significant difference, but for consular matters, the European Union does not include it in the base law regarding this matter. And this makes it difficult for the European Union to implement their representation on an international scale.
