Abstract
Kitab Undang-Undang Hukum Pidana (KUHP) yang merupakan Instrumen hukum tertulis untuk menanggulangi tindak pidana di Indonesia belum dapat menjangkau berbagai permasalahan yang muncul saat ini, contohnya perbuatan cabul pasangan dewasa sesama kelamin dalam kasus pesta seks gay di Indonesia. Pasal 292 KUHP mengatur perbuatan cabul yang dilakukan sesama kelamin namun terbatas pada orang dewasa dengan anak di bawah umur karena KUHP Indonesia yang mengenal adanya Asas Legalitas. Penelitian ini mengangkat permasalahan kekosongan hukum perbuatan cabul pasangan dewasa sesama kelamin dengan kerelaan kedua belah pihak dalam KUHP Indonesia sehingga perlu adanya kriminalisasi dalam bentuk pembaharuan hukum pidana yang diwujudkan dengan kebijakan hukum pidana yang mempertimbangkan aturan perbuatan cabul sesama kelamin di Brunei Darussalam, Russia, dan Nigeria. Peneliti menggunakan pendekatan perundangundangn, pendekatan sejarah, dan pendekatan perbandingan. Bahan hukum yang diperoleh dianalisis menggunakan teknik analisis preskriptif. Hasil dari penelitian ini adalah kekosongan hukum perbuatan cabul sesama kelamin disebabkan karena KUHP Indonesia yang merupakan warisan Belanda yang saat dibentuk masih berorientasi melindungi anak di bawah umur dari perbuatan cabul yang dianggap keji sehingga implikasi hukum adanya kekosongan tersebut adalah ketidakpastian hukum dalam hukum pidana di Indonesia. Oleh karena itu, peneliti memberikan usulan formulasi kualifikasi delik dan pemidanaan guna menjerat para pelaku perbuatan cabul pasangan dewasa sesama kelamin dengan kerelaan kedua belah pihak di masa yang akan datang di Indonesia.
English Abstract
Criminal Code, a written legal instrument to tackle any criminal issues in Indonesia, has not managed to reach all areas of criminal issues happening these days. For example, the fornication done by same-sex adults in gay party in Indonesia has not even been clearly regulated. Article 292 of Criminal Code regulates fornication done between same-sex couple but it is only restricted to the case done by an adult to an under age child simply because the Criminal Code of Indonesia complies with the existence of legality principles. This research is focused on the absence of law that should regulate the fornication between the two same-sex adults as both parties have agreed in Indonesian Criminal Code, and it is essential that there be criminalisation in the form of renewed policy of criminal law that considers regulations of fornication between same-sex adults applied in Brunei Darussalam, Russia, and Nigeria. This research employed statute, historical, and comparative approaches, while the legal materials obtained were analysed with the prescriptive analysis technique. The research result reveals that the absence of law that should regulate fornication done by adults of the same sex is caused by the fact that Indonesian Criminal Code is passed from the Dutch whose regulation was still restricted to under age victims, which was considered cruel. This brings to the legal implication of the absence of law where there is no legal certainty of the criminal law in Indonesia. In this case, the author aims to suggest that there should be a formulation of offense and criminalisation to punish adults involved in same-sex fornication as both parties have agreed in the future.
