Abstract

Penerapan Instruksi Gubernur DIY Nomor. K.898/I/A/1975 tentang penyeragaman policy pemberian hak atas tanah kepada seorang WNI Non Pribumi bertentangan dengan Pasal 21 Ayat(1) Undang-undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-pokok Agraria. Pemberlakuan Instruksi .Gubernur yang membedakan. antara WNI pribumi dan Non pribumi .tersebut tidak mencerminakan asas equality before the law yang mana seharusnya Seluruh warga Negara Indonesia sama di mata hukum. Berdasarkan hal tersebut, penulis membuat penelitian ini dengan tujuan mendeskripsikan dan menganalisis Kedudukan Hukum terkait Instruksi Kepala Daerah Propinsi Daerah Istimewa Yogyakarta Nomor K.898/I/A/1975 Tentang Penyeragaman Policy Pemberian Hak Atas Tanah Kepada Seorang WNI Non Pribumi dalam Hirarki Peraturan Perundang-undangan di Indonesia serta memverifikasi pencerminan asas persamaan dalam hukum di dalam Instruksi Nomor. K.898/I/A/1975. Metode penelitian yang digunakan dalam penulisan tesis ini adalah penelitian yuridis normative dengan menggunakan pendekatan Perundang-undangan (statute approach), Pendekatan Historis (historical approach), Pendekatan kasus (case approach). Hasil penelitian menunjukkan jika Instruksi Nomor. K.898/I/A/1975 memenuhi kualifikasi sebagai peraturan berdasarkan Pasal 7 ayat (1), 8 ayat (1,2) Undang-undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang- undangan. Berdasarkan Stuffenbau des Recht (teori hirarki peraturan perundang- undangan) Kedudukan Instruksi Gubernur D.I.Y Nomor. K.898/I/A/1975 tidak lebih tinggi dari Undang-undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-pokok Agraria. Berdasarkan asas lex superiori derogate lex inferiori Instruksi Gubernur tidak boleh bertentangan dengan Undang-undang yang ada diatasnya. Isi dari instruksi Nomor. K.898/I/A/1975 bertentangan dengan pasal 21 Ayat (1) UUPA. Substansi keistimewaan pertanahan DIY sebatas pada pengelolaan tanah Kasultanan dan tanah Pakualaman. Pelaksanaan Instruksi Nomor K.898/I/A/1975 hingga saat ini memberikan gambaran ketidakadilan bagi Warga Negara Indonesia yang membedakan Warga Negara Indonesia Pribumi dan Non Pribumi di wilayah Yogyakarta. Hal tersebut jelas tidak mencerminkan asas equality before the law di Negara hukum Indonesia. Dari hasil penelitian ini, dapat disimpulkan bahwa berdasarkan asas lex superiori derogate lex inferiori Instruksi Gubernur Nomor K.898/I/A/75 tidak lebih tinggi dari UUPA. Isi dari Instruksi tersebut bertentangan dengan Undang- undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-pokok Agraria. v Pelaksanaan Instruksi Gubernur Nomor K.898/I/A/75 hingga saat ini tidak mencerminkan asas equality before the law

English Abstract

Implementation of Governor Instruction of Special Region of Yogyakarta Number K.898/I/A/1975 on the uniformity of policy over transferring land right to a non-native permanent resident, which does not comply with Article 21 Paragraph (1) of Law Number 5 of 1960 on Basic Regulation of Agrarian Principles. The implementation of Governor Instruction which distinguishes native and non-native permanent residents does not reflect the principle of equality before the law. Therefore, this research is aimed to describe and analyse the legal standing related to the instruction of Regional Head of the Province of Special Region of Yogyakarta Number K.898/I/A/1975 on uniformity of policy over transferring land right to a non-native permanent resident of Indonesia within the scope of laws in Indonesia and to verify the implementation of equality principle in law regarding the Instruction Number K.898/I/A/1975. The research method employed comprised juridical normative method with statute, historical, and case approaches. The research result reveals that the Instruction Number K. 898/I/A/1975 has met the qualification as a regulation according Article 7 Paragraph (1), 8 Paragraph (1,2) of Law Number 12 of 2011 on Formation of Laws. It is argued in Stuffenbau desRecht (a theory of hierarchy of laws) that the position of Governor Instruction of Special Region of Yogyakarta Number K898/I/A/1978 is not higher that Law Number 5 of 1960 on Basic Regulation of Agrarian Principles. Referred to the principle of lexsuperioriderogate lexinferiori, the Governor Instruction must comply with the Law above it. The substance of Instruction Number K.898/I/A/1975 does not comply with Article 21 paragraph (1) of Basic Agrarian Law. The substance of land regulation in the Special Region of Yogyakarta is restricted to the land of Kingdom and the land of Pakualaman(independent Kingdom). The implementation of Instruction Number K.898/I/A/1975 has reflected injustice for native and non-native permanent residents of Indonesia living in Yogyakarta. This surely does not implement the principle of equality before the law. The research result concludes that based on the principle of lexsuperioriderogate lexinferiori, the Governor Instruction Number K.898/I/A/75 is not higher than Basic Agrarian Law. The substance of Instruction does not comply with Law Number 5 of 1960 on Basic Regulation of Agrarian Principles. The Execution of Governor Instruction Number K.898/I/A/75 has not reflected any principle of equality before the law.
