Abstract

Penulisan skripsi ini dilatarbelakangi oleh karena Gereja Masehi Advent Hari Ke-Tujuh Jemaat Terusan Surabaya Malang merupakan salah satu rumah ibadah (gereja) yang belum memperoleh ijin sebagai tempat ibadah. Peraturan Bersama Menteri Agama dan Menteri Dalam Negeri Nomor 9 dan 8 Tahun 2006 tentang Pedoman Pelaksanaan Tugas Kepala Daerah/Wakil Kepala Daerah Dalam Pemeliharaan Kerukunan Umat Beragama, yakni wajib memenuhi persyaratan administratif dan persyaratan teknis bangunan gedung. Masalahnya adalah tidak terpenuhinya unsur persetujuan beberapa warga terhadap gereja tersebut sehingga menghalangi prosesi ijin gereja tersebut. Gereja Masehi Advent Hari Ke-Tujuh Jemaat Terusan Surabaya Malang dipilih karena berada di tengah kota Malang sedari tahun 1974, namun belum mengantongi ijin sebagai tempat ibadah. Tujuan dari penelitian ini yaitu untuk mengetahui bagaimana peraturan yang diberikan oleh pemerintah kota Malang perihal masalah perijinan gereja tersebut. Penelitian ini menggunakan metode sosio legal dengan pendekatan yuridis sosiologis yang mengidentifikasi dan mengkonsepsikan hukum sebagai institusi sosial yang riil dan fungsional dalam sistem kehidupan nyata. Kemudian menggunakan teknik wawancara terhadap sejumlah narasumber. Setelah data-data yang dibutuhkan terkumpul, maka dilakukan analisis dengan teknik analisis deskriptif kualitatif yang mendeskripsikan dari hal yang khusus menjadi suatu kesimpulan yang umum agar dapat tersajikan dalam penulisan yang lebih sistematis untuk menjawab isu hukum yang telah dirumuskan.

English Abstract

This research departed from the fact that the Seventh Day Adventist Church of the worshippers of Terusan Surabaya Malang is one of the places of worship that is not granted a permit that allows this church to be the place for worshipping. Joint Regulations of the Minister of Religion and the Minister of Home Affairs Number 9 and 8 of 2006 concerning Guidelines of Implementation of the tasks of Local Heads in maintaining peace among people across religions imply that a place of worship must meet administrative and technical requirements as a building; no agreement was made between residents and those in charge of the church development, leading to an issue in the permit issuance process for the operation of the church. The Church has existed since 1974 and sits in the city center but no permit has been issued for this church as a place of worship. This research aims to investigate the local regulation regarding the permit of the church. With socio-legal methods and socio-juridical approaches, this research is also intended to identify and conceptualize the law as a real and functional social institution in day-to-day life. The research data were obtained from interviews, followed by the data analysis using qualitative-descriptive analyses intended to transform a specific description into a more general conclusion for a more systematic presentation of the research writing regarding the issue discussed.
