Abstract

Dalam skripsi ini penulis mengangkat permasalahan tentang kebijakan “Bebas Visa Kunjungan (BVK) terhadap warga negara asing dan pengaruhnya terhadap stabilitas Nasional. Dalam pemilihan tema tersebut dilatar belakangi karena peneliti masih menemukan adanya pelanggaran dari pihak-pihak yang menerima Bebas Visa Kunjungan dan/atau pengawasan dari Pemerintah yang” masih minim. Dalam kebijakan Bebas Visa Kunjungan ini diatur dalam Perpres “nomor 21 tahun 2016. Berdasarkan hal ini rumusan masalah dalam penelitian ini adalah (1) Apakah langkah Pemerintah dengan menerbitkan Perpres nomor 21 tahun 2016 sudah tepat dengan diberlakukannya kebijakan kunjungan bebas visa? (2) Apakah pemberlakuan kebijakan kunjungan bebas visa berpotensi” mengganggu terhadap stabilitas nasional? Metode yang digunakan dalam “penelitian ini menggunakan Yuridis Normatif dengan menggunakan pendekatan perundang-undangan (Statute Approach), dan pendekatan kasus (Case Approach).” Dari hasil penelitian yang dilakukan penulis dapat disimpulkan bahwa “Perpres Nomor 21 tahun 2016 Tentang Bebas Visa Kunjungan belum sepenuhnya berjalan sesuai dengan harapan. Hal ini dikarenakan pihak Pemerintah, dalam hal ini Direktorat Jendral Imigrasi Kementrian Hukum dan Hak Asasi Manusia belum melakukan penerapan dan pengawasan secarap tepat dan” maksimal, dan juga dipengaruhi oleh masyarakat yang masih kurangnya “kesadaran dan pengetahuan tentang peraturan yang berlaku. Antisipasi yang dilakukan pihak Direktorat Jendral Imigrasi Kementrian Hukum dan Hak Asasi Manusia sudah cukup baik namun dapat ditingkatkan lagi.”

English Abstract

In this thesis the writer raises issues related to the visa exemption for short visit s policy for foreigner and its effects to national stability. In choosing the theme, the background was because researchers still found that there were law infringement from those who receives visa exemption for short visit and/or government control that is still not enough. The visa exemption for short visit is regulated in Presidential Regulation Number 21 of 2016 concerning Visa Exemption For Short Visit. Based on this, the formulation of the problem in this research is (1) What is the Government steps by publishing Presidential regulation number 21 of 2016 were right decision after enactment policies of visa exemption for short visit? ? (2) What is the enactment of visa exemption for short visit s policies has its effects to national stability? The method used in this research is Judical Normatif by using a statute approach and case approach. From the results of the research conducted by the author, it can be concluded that Presidential Regulation Number 21 of 2016 concerning Visa Exemption For Short Visit has not been fully implemented due to several factors. “This is because the Directorate General of Immigration The Ministry of Law and Human Rights RI were not applied the regulations effectively, and also influenced by the community who still lacks awareness and knowledge of applicable regulations. The anticipations made by the Directorate General of Immigration The Ministry of Law and Human Rights RI are good enough but can be improved.”
