Abstract

Dalam skripsi ini, penulis mengangkat permasalahan mengenai implementasi pasal 12 huruf c Undang-Undang Nomor 18 Tahun 2013 tentang Pencegahan dan Pemberantasan Perusakan Hutan terhadap Penebangan Hutan secara liar oleh Masyarakat di Kabupaten Sijunjung. Penulis menemukan adanya beberapa masalah terkait implementasi yang tidak sesuai dengan pasal 12 huruf c Undang-Undang Nomor 18 Tahun 2013 di Kabupaten Sijunjung. Berdasarkan hal tersebut diatas penulis mengangkat rumusan masalah yaitu : (1) Bagaimana implementasi pasal 12 huruf c Undang-Undang Nomor 18 Tahun 2013 tentang Pencegahan dan Pemberantasan Perusakan Hutan terhadap penebangan hutan secara liar oleh masyarakat di Kabupaten Sijunjung? (2) Apa hambatan dalam implementasi pasal 12 huruf c Undang-Undang Nomor 18 Tahun 2013 tentang Pencegahan dan Pemberantasan Perusakan Hutan terhadap penebangan hutan secara liar oleh masyarakat di Kabupaten Sijunjung? (3) Bagaimana solusi yang dilakukan oleh UPTD KPHL Sijunjung dalam mengatasi maraknya penebangan hutan secara liar di Kabupaten Sijunjung? Penelitian ini bertujuan untuk mengetahui, menganalisis implementasi pasal 12 huruf c Undang-Undang Nomor 18 Tahun 2013 tentang Pencegahan dan Pemberantasan Perusakan Hutan terhadap penebangan hutan secara liar oleh masyarakat di Kabupaten Sijunjung dan hambatan dalam implementasi pasal 12 huruf c Undang-Undang Nomor 18 Tahun 2013 serta upaya yang dilakukan UPTD KPHL Kabupaten Sijunjung dalam mengatasi maraknya penebangan hutan secara di Kabupaten Sijunjung. Penelitian ini dilakukan dengan cara penelitian yuridis empiris dengan metode pendekatan yuridis sosiologis, dengan menggunakan data primer dan data sekunder, serta dengan memperoleh data dengan wawancara dan observasi langsung. Berdasarkan hasil penelitian menggunakan metode diatas, penulis memperoleh jawaban atas permasalahan yang diangkat bahwa dalam implementasi pasal 12 huruf c Undang-Undang Nomor 18 Tahun 2013 tentang implementasi pasal 12 huruf c Undangxiii Undang Nomor 18 Tahun 2013 di Kabupaten Sijunjung masih marak terjadi, dan ditemui beberapa hambatan dalam implemetasi pasal 12 huruf c Undang-Undang Nomor 18 Tahun 2013.

English Abstract

In this thesis, the author raises the issue regarding the implementation of Article 12 letter c of Law Number 18 of 2013 concerning Prevention and Eradication of Forest Destruction against Illegal Logging of Forests by Communities in Sijunjung Regency. The author found that there were several problems related to implementation that was not in accordance with Article 12 letter c of Law Number 18 of 2013 in Sijunjung Regency. Based on the above, the writer raises the formulation of the problem, namely: (1) How is the implementation of Article 12 letter c of Law Number 18 of 2013 concerning Prevention and Eradication of Forest Destruction against illegal logging by the community in Sijunjung Regency? (2) What are the obstacles in the implementation of Article 12 letter c of Law Number 18 of 2013 concerning Prevention and Eradication of Forest Destruction against illegal logging by the community in Sijunjung Regency? (3) How is the solution taken by UPTD KPHL Sijunjung in overcoming the rampant illegal logging in Sijunjung Regency? This study aims to determine, analyze the implementation of Article 12 letter c of Law Number 18 of 2013 concerning Prevention and Eradication of Forest Destruction against illegal logging by the community in Sijunjung Regency and the obstacles in implementing Article 12 letter c of Law Number 18 of 2013 and the efforts made by the UPTD KPHL of Sijunjung Regency in overcoming the rampant deforestation in Sijunjung Regency. This research was conducted by means of empirical juridical research with a sociological juridical xv approach, by using primary and secondary data, and by obtaining data by interview and direct observation. Based on the results of the research using the above method, the authors obtained answers to the problems raised that in the implementation of Article 12 letter c of Law Number 18 of 2013 concerning the implementation of Article 12 letter c of Law Number 18 of 2013 in Sijunjung Regency is still rife, and found several obstacles in the implementation of Article 12 letter c of Law Number 18 of 2013.
