Abstract

Latar belakang penelitian ini adalah melihat kondisi bidang-bidang tanah di Indonesia menurut data yang ada dari Kementerian ATR / Badan Pertanahan Nasional pada 2018 ada 60% dari 126 jutaan bidang tanah yang belum terdaftar, sehingga berpotensi menyebabkan sengketa. Kondisi permasalahan pendaftaran tanah selama ini terkait rumitya dan mahalnya biaya proses pembuatan sertifikat tanah. Jokowi memberikan perhatian pada permasalahan tersebut dan memasukkannya ke dalam program prioritas pemerintahan “Nawa Cita” di bidang reforma agrarian khususnya kepemilikan akta tanah. Dorongan percepatan target pemerintah untuk mensertifikatkan semua bidang tanah pada tahun 2025 menjadi sebab dikeluarkannya Peraturan Menteri Agraria dan Tata Ruang / Kepala Badan Pertanahan Nasional Nomor 6 Tahun 2018 tentang Pendaftaran Tanah Sistematis Lengkap dengan menambahkan pelaksanaannya berbasis partisipasi masyarakat. Penambahan Berbasis partisipasi masyarakat untuk membantu petugas puldatan bekerja dengan cepat dan cermat di lapangan. Penelitian ini difokuskan pada model implementasi kebijakan milik Grindle bahwa kebijakan PTSL+PM sebagai proses politik dan administrasi. Dalam penelitian ini digunakan metode penelitian kualitatif dengan jenis penelitian yang digunakan adalah policy research, deskriptif (berdasarkan tingkat eksplanasi dan berdasarkan tempat). Pengumpulan data dilakukan dengan teknik observasi, interview dan dokumentasi. Teknik analisa data yaitu model Cresswell dengan menekankan pada teknik coding. Sedangkan untuk teknik keabsahan data menggunakan kredibilitas dan triangulasi sumber. Hasil temuan dilapangan, implementasi kebijakan PTSL+PM di Desa Dukuh sudah berjalan dengan cukup baik, total pendaftar 80% dari total kuota 2500 bidang tanah. Hal ini dilihat dari antusias partisipasi masyarakat Desa Dukuh yang tinggi karena kesadaran masyarakat untuk mendapatkan kepastian hukum atas kepemilikan tanah. Komunikasi yang baik mengoptimalkan PTSL+PM di Desa Dukuh antara panitia dan masyarakat. Keseriusan Pemerintah Desa Dukuh dalam implementasi PTSL+PM untuk menata kembali dokumen administrasi pertanahan di tingkat desa sehingga membantu Desa Dukuh dapat menganalisis potensi Desa seperti pemetaan lahan komoditas Tebu, dan program optimalisasi peningkatan kesejahteraan masyarakat Desa Dukuh. Outcome dari kebijakan PTSL+PM masih sebatas wacana belum ditindaklanjuti sebagai program kegiatan pemberdayaan yang mendukung akses modal dan produktifitas ekonomi masyarakat. Kendala yang membuat beberapa masyarakat tidak dapat memenuhi persyaratan pengajuan sertifikat tanah dikarenakan kurangnya data yuridis pemohon seperti belum ada surat keterangan ahli waris dan forum untuk mengatasinya

English Abstract

The background of this research is to see the condition of the fields of the land in Indonesia, according to data from the Ministry of ATR / National Land Agency in 2018 there are 60% of 126 millions of parcels of land that has not been registered, so the potential cause of the dispute. The current problems of land registration are related with the complicated procedure and the high cost of the process of making the land certificate. President Jokowi give attention to this issue and put it in the priority program of government namely the Nawa Cita in the field of agrarian reformation on the particular program especially to the ownership of the land certificate. Boost the acceleration of the government's target to make certificate for all parcels of land in 2025 is the main cause of the issuance of a Regulation of the Minister of Agrarian and spatial planning / Head of National Land Agency No. 6 of 2018 on the Registration of the Land Systematically Complete has been enhanced by adding the implementation based on community participation. Additions Based on community participation to help puldatan officers work quickly and accurately in the field. This research is focused on the model of the implementation of the policy belongs to Grindle that the policy of the PTSL+PM as a process of political and administrative. In this research used qualitative research method with the type of research used is research policy, descriptive (based on the level of explanation and based on the place). Data collection is done by observation, interviews and documentation, as well as using the technique of data analysis model Cresswell with emphasis on coding techniques. While the technique of data validity using the credibility and triangulation of sources. The findings of the field that the implementation of the policy PTSL+PM in the Village of Hamlet has been running fairly well and reach registration targets 80% of the total quota of 2500 plots of land. It’s seen from the highness of enthusiastic participation of the people of the Village of Dukuh because of the awareness of the public to obtain legal certainty rights to land ownership. Good communication being the key to optimal PTSL+PM in the Dukuh Village between the committee and the community. The seriousness of the Government of Dukuh Village in the implementation of PTSL+PM to reorganize the documents of land administration at the village level so as to help the Village of Dukuh can analyze the potential of the Village such as mapping land for sugar cane, and optimize the program to improve the welfare of the Dukuh Village community. The outcome of the policy PTSL+PM is still limited discourse that has not been followed up as a program empowerment activities that support access to capital and economic productivity of society. While the obstacles that make some people not able to meet the requirements of the filing of the certificate of land due to the lack of juridical data of the applicant as yet no letter of the heirs and the place to resolve it
