Abstract

Prostitusi dalam arti terangnya adalah pelacur atau pelayan seks atau Pekerja Seks Komersial (PSK) atau disebut juga Penyedia Jasa Seks Komersial. Ternyata penduduk asli di daerah kawasan wisata di Tretes Kecamatan Prigen hanya menjadi buruh dari para pelaku prostitusi dan mereka ini berasal dari daerah lain serta tidak pernah menetap. Prostitusi atau pelacuran mutlak harus ditanggulangi tidak saja karena akibat-akibatnya yang membahayakan, tetapi juga agar gejala ini tidak diterima oleh masyarakat sebagai pola budaya, dengan kata lain prostitusi yang dibiarkan tanpa dicegah dan ditanggulangi lambat laun dapat dipandang oleh masyarakat yang bersangkutan sebagai hal yang normal dan wajar dan mungkin akan melembaga sebagai hal-hal yang patut, untuk itu pemerintah harus berusaha terus menerus untuk menanggulanginya, sehingga dari generasi ke generasi memandang pelacuran sebagai gejala yang buruk dan tidak dapat diterima oleh budaya manapun.Meski telah banyak yang dilakukan oleh pemerintah untuk dapat memberantas praktek prostitusi yang tidak dapat secara langsung dihilangkan, namun paling tidak upaya-upaya tersebut dapat mengurangi perluasan praktek-praktek prostitusi. Sesungguhnya masyarakat sendiri telah mengetahui dampak-dampak negatif dari praktek prostitusi namun masih saja ada yang menggunakan jasa para Wanita Tuna Susila (WTS), yang sekarang ini istilah tersebut lebih diperhalus bahasanya menjadi Pekerja Seks Komersial (PSK). Pasal 10 Peraturan Daerah Kabupaten Pasuruan Nomor 3 Tahun 2017 Tentang Penanggulangan Pelacuran, dalam hal ini Satpol PP memiliki Kewenangan yang di berikan UU untuk mengatasi sekaligus memberantas Praktik Pelacuran. Namun Saat ini Praktik Pelacuran yang merupakan persoalan kompleks di Pasuruan khususnya di Kawasan Tretes, Kecamatan Prigen Kabupaten Pasuruan ini bersifat terselubung dan memiliki sindikat yang rumit sehingga sulit untuk diberantas. Wisma, Motel Dan Villa yang menjadi tempat Praktek pelacuran di Kawasan Tretes, Kecamatan Prigen Kabupaten Pasuruan yang tetap berlangsung. membuat penulis tertarik untuk meneliti lebih lanjut bagaimana peran pemerintah khususnya Satpol PP dalam Upaya preventif dan promotif dalam Pemberantasan Pelacuran Di Kabupaten Pasuruan. Dari analisa sementara penulis menunjukan bahwa adamya permasalahan dalam realisasi Pasal 10 Peraturan Daerah Kabupaten Pasuruan Nomor 3 Tahun 2017 Tentang Penanggulangan Pelacuran. Penelitian hukum ini adalah penelitian yuridis empiris dengan menggunakan pendekatan yuridis sosiologis.Kemudian seluruh data dianalisa secara deskriptif kualitatif, yaitu berpedoman pada suatu peristiwa yang ada pada lokasi obyek penelitian kemudian dianalisis dengan memberikan kesimpulan.

English Abstract

Prostitution in its clearest sense is a prostitute or sex servant or Commercial Sex Worker (PSK) or also known as a seller of sexual services. It turns out that the indigenous people in the tourist area of Tretes, Prigen Sub-district, only work as laborers for prostitutes and they come from other areas and have never settled. Prostitution or prostitution absolutely must be tackled not only because of its harmful consequences, but also so that this phenomenon is not accepted by the community as a cultural pattern, in other words prostitution that is left unchecked and overcome can gradually be seen by the community concerned as a normal thing. and reasonable and may be institutionalized as things that are appropriate, for that the government must strive continuously to overcome it, so that from generation to generation view prostitution as a bad symptom and cannot be accepted by any culture. Although much has been done by the government to can eradicate the practice of prostitution which cannot be directly eliminated, but at least these efforts can reduce the expansion of prostitution practices. In fact, the community itself already knows the negative impacts of prostitution, but there are still those who use the services of prostitutes (WTS), whose language is now being refined into Commercial Sex Workers (PSK). Article 10 Pasuruan Regency Regulation Number 3 of 2017 concerning the Prevention of Prostitution, in this case the Satpol PP has the authority given by law to overcome and at the same time eradicate the practice of prostitution. However, currently the practice of prostitution, which is a complex problem in Pasuruan, especially in the Tretes area, Prigen District, Pasuruan Regency, is disguised and has complex syndicates, making it difficult to eradicate. Wisma, Motel and Villa which are the places where the practice of prostitution in the Tretes area, Prigen District, Pasuruan Regency continues. makes the author interested in further researching how the role of the government, especially the Satpol PP in preventive and promotive efforts in the Eradication of Prostitution in Pasuruan Regency. From the analysis while the author shows that there are problems in the realization of Article 10 of the Regional Regulation of Pasuruan Regency Number 3 of 2017 concerning Combating Prostitution. This legal research is an empirical juridical research using a sociological juridical approach. Then all data are analyzed descriptively qualitatively, which is guided by an event that is at the location of the research object and then analyzed by providing conclusions.
