Implementasi Pasal 20 Ayat (4) Peraturan Menteri Pekerjaan Umum Nomor 03/PRT/M/2013 Tentang Kriteria Pembuatan Tempat Pembuangan Sementara (TPS) Sampah di Surabaya

Abstract

Peraturan tentang kriteria dalam pembuatan Tempat Penampungan Sementara (TPS) tekmaktub pada Pasal 20 Ayat (4) Peraturan Menteri Pekerjaan Umum Nomor 03/PRT/M/2013 tentang Penyelenggaraan Prasarana dan Sarana Persampahan dalam Penanganan Sampah Rumah Tangga dan Sampah Sejenis Sampah Rumah Tangga yang berbunyi : TPS sebagaimana dimaksud pada ayat (3) harus memenuhi kriteria teknis: a. Luas TPS sampai dengan 200 m2; b. Tersedia sarana untuk mengelompokkan sampah menjadi paling sedikit 5 (lima) jenis sampah; c. Jenis pembangunan penampung sampah sementara bukan merupakan wadah permanen; d. Luas lokasi dan kapasitas sesuai kebutuhan; e.Lokasinya mudah diakses; f. Tidak mencermari lingkungan; g. Penempatan tidak mengganggu estetika dan lalu lintas; dan h. Memiliki jadwal pengumpulan dan pengangkutan.” Pada peraturan ini beberapa kriteria dalam pembuatan TPS ialah penempatan TPS tidak mengganggu estetika dan lalu lintas. Namun di kota-kota besar termasuk di Kota Surabaya sering menjumpai beberapa TPS yang berada di tepi jalan sehingga mengganggu estetika jalan serta menimbulkan bau yang menyengat dan membuat pengguna jalan merasa tidak nyaman saat melalui jalan tersebut serta pada saat truk sampah akan mengangkut sampah di TPS, truk sampah akan menggunakan ruas jalan untuk parkir sehingga sering menimbulkan kemacetan terutama untuk TPS yang berada di tepi jalan raya yang memiliki dua arus. Atas kondisi tersebut, karya tulis ini mengangkat rumusan masalah : 1. Bagaimana implementasi Pasal 20 ayat (4) Peraturan Menteri Pekerjaan Umum Nomor 03/PRT/M/2013 tentang kriteria pembuatan Tempat Penampungan Sementara (TPS) di Surabaya? 2. Bagaimana dampak yang ditimbulkan dari pembuatan tempat penampungan sementara (TPS) sementara yang tidak sesuai kriteria yang telah ditetapkan? Jenis penelitian ini ialah yuridis empiris dengan menggunakan pendekatan sosiologis. Sumber data primer yang digunakan adalah para pekerja dan masyarakat sekitar Tempat Pembuangan Sementara (TPS) Sampah Siwalankerto Surabaya. Sumber data sekunder adalah Peraturan Menteri Pekerjaan Umum Nomor 03/PRT/M/2013 dan jurnal-jurnal, artikel-artikel tentang pembuatan Tempat Penampungan Sementara (TPS). Dari hasil penelitian di atas diperoleh jawaban yaitu, Kriteria Tempat Pembuangan Sementara (TPS) Sampah diatur dalam Pasal 20 Ayat (4) Peraturan Menteri Pekerjaan Umum Nomor 03/PRT/M/2013 tentang Penyelenggaraan Prasarana dan Sarana Persampahan dalam Penanganan Sampah Rumah Tangga dan Sampah Sejenis Sampah Rumah Tangga. TPS Siwalankerto yang ada di Surabaya tidak memenuhi kriteria dan tidak mengimplementasikan Pasal 20 Ayat (4) secara keseluruhan yaitu Luas TPS lebih dari 200 m2 dengan luas dari tepi jalan raya dan tepi rel kereta api dan tidak ada bangunan persegi khusus layaknya TPS lainnya, sarana pengelompokkan sampah hanya 3 (tiga) warna yaitu warna orange, hijau dan biru. Pada jenis tempat pembuangan sampah yang tidak sesuai membuat petugas menggunakan warna yang sama untuk jenis sampah yang berbeda dan ditandai dengan cat putih nomor digerobak sampah, dan untuk ketidaksesuaian yang selanjutnya yaitu penempatan mengganggu estetika dan lalu lintas. Implementasi yang tidak maksimal menimbulkan beberapa dampak diantaranya : bau yang mengganggu terlebih pada saat pengumpulan sampah oleh petugas dan pengangkutan sampah, macet pada saat truk sampah berhenti di jalan dan memotong jalan sehingga mobil yang berlawanan arah harus bergantian dan membuat jalanan menjadi macet, bau yang menyengat membuat para pembeli yang berjualan di tepi dan seberang TPS menjadi berkurang minat belanjanya sehingga pedagang sepi dan yang terakhir mengganggu estetika jalan yaitu mulai dari pemandangannya yang tidak nyaman untuk dipandang. Semua dampak ini ditimbulkan karena kriteria Tempat Penampungan Sementara (TPS) yang tidak sesuai dengan kriteria yang ditetapkan oleh pemerintah.

English Abstract

The regulation on the criteria for making Temporary Shelter Places (TPS) tekmaktub in Article 20 Paragraph (4) Regulation of the Minister of Public Works Number 03/PRT/M/2013 concerning the Implementation of Waste Infrastructure and Facilities in Handling Household Waste and Waste Similar to Household Waste which reads : TPS as referred to in paragraph (3) must meet the following technical criteria: a. TPS area up to 200 m2; b. Facilities are available to classify waste into at least 5 (five) types of waste; c. The type of construction of a temporary waste container is not a permanent container; d. Location area and capacity as needed; e.The location is easily accessible; f. Does not pollute the environment; g. Placement does not interfere with aesthetics and traffic; and h. Have a collection and transport schedule.” In this regulation, several criteria in making TPS are that the placement of TPS does not interfere with aesthetics and traffic. However, in big cities, including in Surabaya, you often find several TPS located on the edge of the road so that it interferes with the aesthetics of the road and causes a strong odor and makes road users feel uncomfortable when passing through the road and when garbage trucks will transport garbage at the TPS Garbage trucks will use the road for parking so that it often causes congestion, especially for TPS which are on the edge of a highway that has two streams. For these conditions, this paper raises the formulation of the problem: 1. How is the implementation of Article 20 paragraph (4) of the Regulation of the Minister of Public Works Number 03/PRT/M/2013 concerning the criteria for making Temporary Shelters (TPS) in Surabaya? 2. What are the impacts of making temporary shelters (TPS) that do not meet the established criteria? This type of research is empirical juridical using a sociological approach. The primary data sources used are workers and the community around the Siwalankerto Temporary Disposal Site (TPS) in Surabaya. Secondary data sources are the Regulation of the Minister of Public Works Number 03/PRT/M/2013 and journals, articles on the creation of Temporary Shelters (TPS). From the results of the research above, the answer is, the Criteria for Temporary Disposal Sites (TPS) are regulated in Article 20 Paragraph (4) of the Regulation of the Minister of Public Works Number 03/PRT/M/2013 concerning the Implementation of Waste Infrastructure and Facilities in Handling Household Waste and Similar Waste Household waste. The Siwalankerto TPS in Surabaya does not meet the criteria and does not implement Article 20 Paragraph (4) as a whole, namely the TPS area is more than 200 m2 with an area of the edge of the highway and the edge of the railway and there is no special square building like other TPS, grouping facilities trash only 3 (three) colors, namely orange, green and blue. In the type of landfill that is not suitable, the officer uses the same color for different types of waste and is marked with white paint with the number on the garbage wagon, and for further discrepancies, the placement interferes with aesthetics and traffic. Improper implementation causes several impacts including: annoying odors, especially when collecting garbage by officers and transporting garbage, getting stuck when the garbage truck stops on the road and cuts the road so that cars in the opposite direction have to take turns and make the road jammed, a strong smell make buyers who sell on the edge and opposite the TPS less interested in shopping so that the traders are quiet and the last one disturbs the aesthetics of the road, starting from the view that is uncomfortable to look at. All of these impacts are caused by the criteria for Temporary Shelters (TPS) that do not meet the criteria set by the government.
