Abstract
Pada skripsi ini, Penulis mengangkat permasalahan mengenai Article 3 The European Convention on Human Rights yang dimana tindakan penyiksaan dalam pasal konvensi tersebut tidak mendapat kejelasan atau tidak didefinisikan secara tepat mengenai bentuk tindakan seperti apa yang termasuk kedalam tindakan penyiksaan serta tidak dijelaskan batasannya sampai mana dalam hal tindakan penyiksaan tersebut. Berbeda dengan Article 1 Convention againts Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment yang dimana dijelaskan secara rinci mengenai bentuk tindakan penyiksaan tersebut. Implikasi dari ketidakjelasan batasan penyiksaan dalam Article 3 European Convention on Human Rights adalah adanya disparitas (perbedaan) putusan Hakim Uni Eropa dalam memutus perkara terkait dengan dugaan penyiksaan. Hal ini dapat dilihat dalam Case of Devyatkin v. Rusia (Application no. 40384/06) dan Case of Daşlik v. Turkey (Application no. 38305/07), yang dimana hasil putusan kedua kasus tersebut berbeda. Berdasarkan latar belakang penelitian tersebut, terdapat rumusan masalah: Bagaimanakah batasan tindakan penyiksaan menurut Article 3 European Convention on Human Rights jika dilihat dari Case of Devyatkin v. Rusia (Application no. 40384/06) dan Case of Daşlik v. Turkey (Application no. 38305/07)? Penelitian diatas menggunakan pendekatan Yuridis Normаtif dengаn menggunаkаn pendekаtаn perUndаng-Undаngаn (Stаtute Аpproаch) dan pendekatan Kasus (Case Approach). Untuk Bаhаn Hukum Primer diperoleh dаri Perundаng-Undаngаn dan kasus, sedаngkаn Bаhаn Hukum Sekunder dаn Tersier diperoleh dаri buku-buku, dokumen аtаu kepustаkааn dаn kаmus. Bаhаn hukum yаng diperoleh penulis аkаn diаnаlisis dengаn menggunаkаn intrepretаsi grаmаtikаl, sistemаtis dаn komparatif dengan menafsirkan Article 3 European Convention on Human Rights tentang tindakan penyiksaan serta Putusan dari Case of Devyatkin v. Rusia (Application no. 40384/06) dan Case of Daşlik v. Turkey (Application no. 38305/07) yang menjadi objek penelitian penulis. Dari hasil penelitian dengan menggunakan metode diatas, penulis memperoleh jawaban atas permasalahan yang ada bahwa, menurut para Hakim Eropa, Case of Devyatkin v. Rusia (Application no. 40384/06) merupakan kejadian yang dapat disebut sebagai tindakan penyiksaan yaitu adanya tindakan penyiksaan baik secara fisik maupun psikis yang dilakukan oleh Otoritas Publik, sedangkan Case of Daşlik v. Turkey (Application no. 38305/07) tidak dapat disebut sebagai tindakan penyiksaan karena kejadian tersebut tidak terdapat tindakan penyiksaan secara fisik, namun hanya terdapat tindakan secara psikis, yang didapatkan dari kegiatan interogasi oleh Otoritas Publik. Kedua kasus tersebut pun bertumpu pada hasil putusan terdahulu dari European Court of Human Rights, namun hasil putusan yang menjadi tumpuan pada kedua kasus tersebut pun berbeda.
English Abstract
In this thesis, the author raises the issue of Article 3 of The European Convention on Human Rights , where the act of torture in the article of the convention does not get clarity or is not precisely defined regarding what forms of action are included in acts of torture and the limits are not explained to what extent in this case. the act of torture. In contrast to Article 1 of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment , which describes in detail the form of the act of torture. The implication of the unclear boundaries of torture in Article 3 of the European Convention on Human Rights is the disparity in the decisions of European Union judges in deciding cases related to allegations of torture. This can be seen in Case of Devyatkin v. Russia (Application no. 40384/06) and Case of Daşlik v. Turkey (Application no. 38305/07), where the results of the two cases are different. Based on the background of the research, there is a problem formulation: What are the limits of acts of torture according to Article 3 of the European Convention on Human Rights when viewed from the Case of Devyatkin v. Russia (Application no. 40384/06) and Case of Daşlik v. Turkey (Application no. 38305/07)? The research above uses a normative juridical approach by using a statute approach and a case approach. Primary legal materials are obtained from legislation and cases, while secondary and tertiary law materials are obtained from books, documents or libraries and dictionaries. The legal material obtained by the author will be analyzed using a grammatical, systematic and comparative interpretation by interpreting Article 3 of the European Convention on Human Rights regarding acts of torture and the Decision of the Case of Devyatkin v. Russia (Application no. 40384/06) and Case of Daşlik v. Turkey (Application no. 38305/07) which is the object of the author's research. From the results of the research using the above method, the authors obtain answers to the existing problems that, according to the European Judges, the Case of Devyatkin v. Russia (Application no. 40384/06) is an incident that can be called an act of torture, namely the existence of acts of torture both physically and psychologically by the Public Authority, while the Case of Daşlik v. Turkey (Application no. 38305/07) involve cannot be called an act of torture because the incident did notphysical acts of torture, but only psychological acts, which were obtained from interrogation activities by the Public Authority. Both cases also rely on the results of previous decisions from the European Court of Human Rights, but the results of the decisions that are the basis of the two cases are also different.
