Abstract

Pada karya tulis ini penulis mengangkat isu mengenai penambangan pasir laut illegal yang berlokasi di Desa Ambunten Tengah, Kecamatan Ambunten, Kabupaten Sumenep. Di Kabupaten Sumenep sebenarnya telah mempunyai peraturan mengenai larangan untuk menambang pasir lau pada wilayah Kabupaten Sumenep yaitu Peraturan Daerah Kabupaten Sumenep Nomor 8 Tahun 2013 tentang Pengelolaan Wilayah Pesisir dan Pulau-Pulau Kecil akan tetapi peraturan ini masih belum efisien untuk mengatasi penambangan pasir laut illegal. Berdasarkan penjelasan diatas, rumusan masalah yang dapat diangkat diantaran (1) Bagaimana penegakan hukum terhadap penambangan pasir laut ilegal yang berada di Desa Ambunten Tengah Kecamatan Ambunten Kabupaten Sumenep? (2) Bagaimana hambatan dan upaya pemerintah dalam mengatasi permasalahan penambangan pasir laut ilegal yang sangat masif terjadi di Desa Ambunten Tengah Kecamatan Ambunten Kabupaten Sumenep? Kemudian jenis penelitian yang digunakan oleh penulis yaitu penelitian yurudis empiris dan penulis menggunakan pendekatan yuridis sosiologis, serta teori yang digunkan penulis untuk karya tulis ini adalah teori penegakan hokum dari Soerjono Soekanto. Dari hasil penelitian yang penulis lakukan, penulis memperoleh jawaban bahwasanya Peraturan Daerah Kabupaten Sumenep Nomor 8 tahun 2013 belum efektif. Hal ini dipengaruhi oleh lima factor yaitu, faktor hukum, faktor penegakan hokum, faktor sarana dan fasilitas pendukung, faktor masyarakat, dan faktor kebudayaan.

English Abstract

In this paper the author raises the issue of illegal sea sand mining which is located in Ambunten Tengah Village, Ambunten District, Sumenep Regency. In Sumenep Regency, there is actually a regulation regarding the prohibition of mining lau sand in the Sumenep Regency area, namely the Regional Regulation of Sumenep Regency Number 8 of 2013 concerning Management of Coastal Areas and Small Islands, but this regulation is still not efficient to overcome illegal sea sand mining. Based on the explanation above, the problem formulations that can be raised are (1) How is the law enforcement against illegal sea sand miners in Ambunten Tengah Village, Ambunten District, Sumenep Regency? (2) What are the obstacles and government efforts in overcoming the massive illegal sea sand mining problem in Ambunten Tengah Village, Ambunten District, Sumenep Regency? Then the type of research used by the author is juridical empirical research and the author uses a sociological juridical approach, and the theory used by the author for this paper is Soerjono Soekanto's theory of law enforcement. From the results of the research conducted by the author, the authors get the answer that the Regional Regulation of Sumenep Regency Number 8 of 2013 has not been effective. This is influenced by five factors, namely, legal factors, law enforcement factors, supporting facilities and facilities, community factors, and cultural factors.
