Abstract
Pada skripsi ini, penulis mengangkat permasalahan mengenаi kepemilikan tanda daftar usaha pariwisata bagi sanggar seni yang merupakan usaha pariwisata pada bidang usaha penyelenggaraan kegiatan hiburan dan rekreasi. Hаl ini dilаtаr belаkаngi oleh minimnya informasi dan sosialisasi terkait dengan kepemilikan tanda daftar usaha pariwisata, sehingga kurangnya pengetahuan masyarakat tentang pentingnya memiliki tanda daftar usaha pariwisata dan juga dapat mengakibatkan tidak berkembangnya kesenian pada masyarakat yang mana seharusnya bisa menjadi daya jual suatu daerah. Berdasarkan alasan diatas maka penulis ingin membahas dan mengangkat judul “Implementasi Pasal 32 Peraturan Menteri Pariwisata Nomor 18 Tahun 2016 Tentang Pendaftaran Usaha Pariwisata Terhadap Sanggar Seni Di Kota Malang (Studi pada Dinas Tenaga Kerja, Penanaman Modal dan Pelayanan Terpadu Satu Pintu Kota Malang)” Berdаsаrkаn hаl tersebut diаtаs, skripsi ini mengаngkаt rumusаn mаsаlаh sаbаgаi berikut: (1) Bagaimana Implementasi Pasal 32 Peraturan Menteri Pariwisata Nomor 18 Tahun 2016 Tentang Pendaftaran Usaha Pariwisata Terhadap Sanggar Seni Di Kota Malang? (2) Apa hambatan dan solusi Implementasi Pasal 32 Peraturan Menteri Pariwisata Nomor 18 Tahun 2016 Tentang Pendaftaran Usaha Pariwisata Terhadap Sanggar Seni Di Kota Malang? Untuk menjawab permasalahan diatas, penulis menggunakan jenis penelitian Yuridis Empiris, metode pendekatan yang digunakan adalah Yuridis Sosiologis, jenis dan sumber data terbagi menjadi jenis, sumber primer dan sekunder, teknik yang digunakan dalam memperoleh data adalah wawancara dan studi kepustakaan, dan teknik analisis data penelitian ini menggunakan teknik deskripstif kualitatif. 7 Dari hasil penelitian sesuai dengan rumusan masalah dan metode yang telah diuraikan di atas bahwa dalam penerapan kepemilikan tanda daftar usaha pariwisata dibutuhkan peran yang sangat besar dari pemerintah terutama dalam hal sosialisasi. Bahkan pelaku seni tidak mengetahui adanya peraturan tentang tanda daftar usaha pariwisata yang dapat menguntungkan pelaku usaha pariwisata dan tentunya bertujuan untuk untuk menjamin kepastian hukum bagi pengusaha pariwisata dalam menyelenggarakan usaha pariwisata, menyediakan sumber informasi bagi semua pihak yang berkepentingan mengenai pendaftaran usaha pariwisata dan memberikan persyaratan dalam melaksanakan sertifikasi usaha pariwisata. Untuk itu pelaku usaha pariwisata memerlukan tanda daftar usaha pariwisata sebagai payung hukum.
English Abstract
In this thesis, the author raises the problem of ownership of a tourism business registration certificate for art studios which is a tourism business in the business sector of organizing entertainment and recreation activities. This is due to the lack of information and socialization related to the ownership of a tourism business registration certificate, so that the lack of public knowledge about the importance of having a tourism business registration certificate can also result in the development of art in the community which should be the selling power of an area. Based on the above reasons, the writer wants to discuss and raise the title "Implementation of Article 32 of the Regulation of the Minister of Tourism Number 18 of 2016 concerning the Registration of Tourism Businesses to Art Studio in Malang City (Study at the Department of Manpower, Investment and One Stop Integrated Service of Malang City)" Berdаsаrkаn That above, this thesis raises the problem formula as follows: (1) How is the Implementation of Article 32 of the Regulation of the Minister of Tourism Number 18 of 2016 concerning the Registration of Tourism Businesses to Art Studio in Malang City? (2) What are the obstacles and solutions to the implementation of Article 32 of the Regulation of the Minister of Tourism Number 18 of 2016 concerning Registration of Tourism Businesses of Art Studio in Malang City? To answer the above problems, the author uses the type of juridical empirical research, the approach method used is juridical sociology, the types and sources of data are divided into types, primary and secondary sources, the techniques used in 9 obtaining data are interviews and literature study, and research data analysis techniques. it uses a qualitative descriptive technique. From the research results in accordance with the formulation of the problem and the method described above, it is necessary to have a very large role from the government, especially in terms of socialization, to apply the ownership of a tourism business registration certificate. Even art actors do not know of any regulations regarding tourism business registration signs that can benefit tourism business actors and of course aim to ensure legal certainty for tourism entrepreneurs in carrying out tourism businesses, providing sources of information for all interested parties regarding tourism business registration and providing requirements for carry out tourism business certification. For this reason, tourism business actors need a tourism business registration certificate as a legal standings
