Abstract

Executive review terhadap peraturan desa dikota batu merupakan pengujian secara internal yang lahir dari pembinaan dan pengawasan oleh pemerintah xiv daerah kabupaten/kota dalam hal ini bupati/walikota. Terdapat beragam pendapat yang berkaitan dengan executive review (pengujian oleh lembaga eksekutif) oleh pemerintah daerah kabupaten/kota terhadap desa terkait dengan kewenangan pengujian tersebut. Sebagaimana diatur dalam Undang-Undang Dasar Negara Republik Indonesia kewenangan pengujian Undang-Undang terhadap Undang-Undang Dasar adalah Mahkamah Konstitusi.1 Sedangkan Mahkamah Agung berwenang mengadili pada tingkat kasasi, menguji peraturan perundang-undangan dibawah undang-undang terhadap undang-undang dan wewenang lainnya yang diberikan oleh undang-undang.2 Berdasarkan kewenangan tersebut kemudian melahirkan model pengujian yaitu secara constitutional review, judicial review, legislative review dan executive review. Selain itu model pengujian executive review ini menawarkan solusi bagi model pengujian secara internal yang artinya pengujian oleh pemerintah yang lebih tinggi terhdap pemerintah yang lebih rendah. Oleh karena itu, untuk memperkuat argumen peneliti menulis terkait dengan executive review terhadap peraturan desa di kota batu. Di samping itu tedapat produk hukum desa yaitu Peraturan Desa Sidomulyo Nomor 2 Tahun 2019 Tentang Kewenangan Desa Berdasarkan Hak Asal Usul dan Kewenangan Lokal Berskala Desa untuk mengetahui sejauh mana pengujian yang di lakukan oleh pemerintah daerah kabupaten/kota dalam hal ini bupati /walikota melalui mekanisme executive review.

English Abstract

Law Number 6 of 2014 concerning Village clarifies the status and authorities of villages in the scope of regency/municipality, and these authorities are regulated in a village government, either the draft or the regulation, that requires evaluation and clarification by a regent/mayor. With normative juridical method, statutory, and case approach, this research aims to direct the executive review on village regulation and the village regulation of Sidomulyo Village Number 2 of 2019 concerning village authorities according to the rights of origin and local authorities in a village. Executive review on village regulation represents internal evaluation under coach and supervision. Furthermore, these authorities bring further to several models of evaluation of constitutional review, judicial review, legislative review, and executive review. The evaluation model of executive review offers a solution to internal evaluation performed by higher government towards the government of lower position. Batu city mostly consists of villages with 19 villages and five sub-districts divided into three districts in the city. Thus, each village in the city needs to formulate a village regulation concerning village authorities according to the rights of origin and the local authorities at rural level, and Sidomulyo village is one of them. Departing from this observation, this research has found out that it is important to analyse to what extent the review is performed by the local governments of regency/municipality through the mechanism of executive review in village regulation making.
