Abstract
Penelitian ini membahas mengenai implikasi yuridis penolakan ibu hamil oleh rumah sakit selama pandemi Covid-19 ini berlangsung. Tujuan dari penelitian ini adalah untuk mengetahui apakah penolakan ibu hamil oleh rumah sakit selama pandemi COVID – 19 merupakan tindak pidana dan juga untuk mengetahui implikasi yuridis penolakan ibu hamil oleh rumah sakit selama pandemi COVID – 19 berlangsung. Adapun penelitian ini menggunakan metode penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan. Kemudian penelitian ini dianalisis dengan menggunakan teknik penafsiran sistematis dan juga gramatikal. Dan hasil dari penelitian dengan menggunakan metode diatas, penulis berpendapat bahwa rumah sakit yang dengan sengaja membiarkan ibu hamil yang masuk ke rumah sakit dan membutuhkan pertolongan namun membiarkan atau bahkan menolak tanpa mendapatkan perawatan sebagaimana seharusnya merupakan suatu tindak pidana karena perbuatan tersebut telah memenuhi unsur-unsur perbuatan pidana yaitu melanggar norma dan diancam dengan saksi berupa hukuman pidana dalam pasal 32 Undang–Undang Nomor 36 Tahun 2009 dan pasal 304, 306 dan juga 531 KUHP. Dan Ibu hamil tersebut dapat mengadukan rumah sakit sesuai persepsinya apakah mau dituntut ke wilayah pidana, di gugat ke wilayah perdata atau diadukan ke Majelis Kehormatan Disiplin Kedokteran Indonesia (MKDKI).
English Abstract
In this thesis, the author raises the problem of rejection of pregnant women with positive rapid test results by the hospital due to the guidelines for practice protocols for maternal and newborn health services that occurred in Indonesia during the Covid-19 pandemic. The choice of this theme was motivated by the hospital's actions that violated human rights and provisions in the law where health care facilities are prohibited from refusing patients and / or asking for advances in an emergency. Based on the statement above, the formulation of the problem in this paper is: (1) Is the rejection of pregnant women by the hospital due to the protocol of practical guidance for maternal and newborn health services during the COVID-19 pandemic is a criminal act? (2) What are the legal implications of the rejection of pregnant women by hospitals due to the protocol of practical instructions for maternal and newborn health services during the COVID-19 pandemic? Thereafter the writing of this thesis uses a normative legal research method using a statutory approach. Furthermore, the primary and secondary legal materials obtained by the author will be analyzed using systematic interpretive techniques and grammatical interpretation techniques. And the results of the research with the method above, the authors get the answer to the existing problem that a hospital that deliberately neglect pregnant women that enter the hospital and needs help but refuses to give treatment as it should be is a criminal act because because the act has fulfilled the elements of a criminal act, namely violating the norms and is threatened with sanctions in the form of criminal penalties in Article 32 of Law Number 36 Year 2009 and Articles 304, 306 and also 531 of the Criminal Code. And the pregnant woman can complain to the hospital according to her perception whether she wants to be prosecuted in a criminal area, sued in a civil area or complained to the Indonesian Medical Discipline Honorary Council (MKDKI).
