Abstract

Pada skripsi ini, penulis mengangkat topik Pertanggungjawaban Atas Terjadinya Tumpahan Minyak Oleh Kapal MV Wakashio Di Kepulauan Mauritius. Pemilihan topik ini dilatar belakangi oleh kecelakaan yang terjadi pada tanggal 25 juli 2020 yang menyebabkan terjadinya tumpahan minyak tepatnya dilepas pantai Kepulauan Mauritius. Atas terjadinya tumpahan minyak ini, Kepulauan Mauritius sebagai negara korban mengalami dampaknya kerugian atas kecelakaan tersebut. Berdasarkan hal tersebut, penulis mengangkat rumusan masalah : (1) Siapa yang bertanggung jawab atas tumpahan minyak dari kapal MV Wakashio di lepas pantai Kepulauan Mauritius tersebut? (2) Bagaimana Bentuk Pertanggungjawaban atas terjadinya tumpahan minyak dari kapal MV Wakashio di lepas pantai Kepulauan Mauritius? Kemudian pada penulisan ini, penulis menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan (statue approach) dan pendekatan kasus (case approach). Bahan hukum primer, sekunder, dan tersier yang diperoleh penulis dianalisis dengan metode deskriptif preskriptif yaitu penulis mengaikatkan dengan perundang-undangan lainnya, teori hukum atau pendapat ahli hukum. Dari hasil penelitian pada penulisan ini, penulis memperoleh jawaban bahwa terdapat pihak-pihak yang bertanggung jawab atas tumpahan minyak yang terjadi, yaitu yang pertama pemilik kapal bahwa pada pasal 3 ayat (1) International Convention on Civil Liability for Bunker Oil Pollution Damage 2001 dikatakan bahwa pemilik dari kapal tersebut bertanggungjawab atas kerusakan yang terjadi yang disebabkan oleh kebocoran minyak. Kapten Kapal dan wakilnya yang telah gagal menavigasi kapal dengan aman didakwa berdasarkan undang-undang setempat, dan negara bendera kapal (Panama) yang memiliki pertanggungjawaban dalam pasal 4 International Convention on Oil Pollution Preparedness, Response and Co-operation (OPRC) untuk menyampaikan laporan hasil investigasi. Dalam bentuk pertanggungjawaban dari pemilik kapal ditetapkan rezim International Convention on Civil Liability for Bunker Oil Pollution Damage 2001 dan Convention on Limitation of Liability for Maritime Claims (LLMC 1976). Pemilik kapal dalam konvensi ini wajib mengambil tanggung jawab asuransi untuk menutupi segala kompensasi atas insiden tersebut. Pemilik kapal yang memiliki tonase kotor lebih dari 1000 diharuskan memiliki asuransi atau keuangan lainnya berdasarkan pasal 7 ayat (1). Negara bendera kapal yaitu Panama agar segera memberikan hasil laporan atas kecelakaan ini sehingga mempermudah untuk mengungkap segera kasus ini. Dan Kepulauan Mauritius sebagai negara korban untuk mengatur lebih lanjut peraturan nasional terkait pencegahan, mengurangi, dan pengendalian pencemaran laut berdasarkan UNCLOS 1982 dan prinsip-prinsip dalam hukum internasional. English Abstract

In this thesis, the author assessed the topic LIABILITY OVER OIL SPILL FROM MV WAKASHIO OFF THE SHORE THE POINTE D”ESNY OF MAURITIUS ISLANDS ACCORDING TO INTERNATIONAL LAW. This topic departs from an accident occurring on July 25 2020 when oil spilled off the shore at the island of Mauritius. Following this accident, the islands have to take losses. Considering the effect of this incident, the author raised the problem formulations as follows: (1) Who is responsible for the oil spill from the MV Wakashio on the offsore of Mauritius Islands? (2) What is the Liability form towards the leaked oil from MV Wakashio on off the coast of Mauritius Islands? With a normative method, statutory, and case approaches, this research took primary, secondary, and tertiary data, which were further analyzed with a descriptiveprescriptive technique by relating the data to other laws, theories of law, or experts’ notions. Several parties have liability over this accident. As set forth in Article 3 paragraph (1) of International Convention on Civil Liability for Bunker Oil Pollution Damage 2001, the vessel owner is responsible for the damage caused, along with the captain and vice-captain failing to navigate the vessel securely. The parties liable for this accident are punishable by the law of the jurisdiction where the accident took place and the law of the state the vessel flag (Panama) represented. The laws dealing with this indifference constitute Article 4 of International Convention on Oil Pollution Preparedness, Response, and Co-operation (OPRC) responsible to submit the report of investigation. In terms of the liability on the side of the vessel owner, the law refers to the regime of International Convention on Civil Liability for Bunker Oil Pollution Damage 2001 and the Convention on Limitation of Liability for Maritime Claims (LLMC 1976). The vessel owner has to register the vessel for insurance to allow full coverage of the damage caused to be implemented. The vessel with a gross tonnage exceeding 1000 is highly required to be registered for insurance as in line with Article 7 paragraph (1). Moreover, it is essential that Panama immediately submit the report of the accident for immediate investigation. In this case, the captain and vice-captain demonstrated unsafe navigation of the vessel at the islands of Mauritius, contravening the existing laws. Following this tragedy, the captain and vice-captain were sentenced to 60 years’ imprisonment. The offenders are to comply with the law under the jurisdiction of Mauritius, while Mauritius should promptly make further national regulations regarding prevention, reduction, and control of marine pollution according to UNCLOS 1982 and the principles of international law.
