Abstract

"Topik penelitian ini berangkat dari tren kebangkitan budaya knock-off terutama dalam desain industri dengan produk siklus hidup pendeknya. Istilah perlindungan hukum dari desain industri di bawah Undang-Undang Nomor 31 tahun 2000 tentang desain industri tidak relevan dengan pendek. Produk hidup siklus yang berlangsung kurang dari satu tahun atau hanya enam bulan. Penelitian ini menyelidiki: (1) Bagaimana perlindungan hukum yang diberikan untuk desain industri ini atas produk siklus hidup pendek sesuai dengan Undang-Undang Nomor 31 tahun 2000 tentang Desain Industri? ( 2) Bagaimana desain industri dari produk siklus hidup pendek ini diatur dalam Undang-Undang Nomor 31 Tahun 2000, ACT Desain Australia 2003, dan Peraturan Dewan Uni Eropa (EC) No. 6/2002 tentang Desain Komunitas? Dengan Metode Yuridis Normatif, Statutory, dan Perbandingan pendekatan, penelitian ini telah mengungkapkan bahwa perlindungan hukum atas desain industri produk siklus hidup pendek belum cukup diterapkan dibandingkan dengan yang diatur dalam ketentuan dalam Desain dasial di negara-negara lain Uni Eropa. English Abstract

"This research topic departs from the rising trend of knock-off culture especially in industrial design with its short life cycle products. The term of the legal protection of industrial design under the Law Number 31 of 2000 concerning Industrial Design is not relevant to the short life- cycle products that last less than a year or just six months. This research investigates: (1) how is the legal protection given for this industrial design over the short life cycle products according to Law Number 31 of 2000 concerning Industrial Design? (2) How is industrial design of this short life cycle products governed in Law Number 31 of 2000, Australian Design Act 2003, and EU Council Regulation (EC) No. 6/2002 on Community Design? With normative juridical method, statutory, and comparative approach, this research has revealed that the legal protection over the industrial design of short life cycle products has not been sufficiently implemented compared to that governed in the provisions of industrial designs in other countries of European Union.
