Abstract

Pada tesis ini, penulis mengangkat permasalahan terkait Tanggung jawab Notaris Atas Pembuatan Akta Wasiat Yang Tidak Dilaporkan Pada Seksi Daftar Pusat Wasiat. Pilihan tema tersebut dilatarbelakangi oleh kelalaian Notaris dalam pembuatan Akta Wasiat yang tidak di daftarkan atau tidak dilaporkan pada seksi daftar pusat wasiat sehingga menimbulkan akibat hukum. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah : (1) Bagaimana Akibat Hukum Yang Ditimbulkan Dari Akta Waris Yang Dibuat Dihadapan Notaris Dan Yang Tidak Dilaporkan Pada Seksi Daftar Pusat Wasiat ? (2) bagaimana tanggung jawab notaris atas pembuatan akta wasiat yang tidak dilaporkan padaSeksi Daftar Pusat Wasiat.? Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif dengan metode pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach), Bahan hukum yang dipergunakan mencakup bahan hukum primer, sekunder dan tersier, dengan analisa bahan hukum yang dipilih adalah Analisa Yuridis yaitu menganalisa berdasarkan pada teori-teori dan konsep dan peraturan perundang-undangan. Setelah itu data yang diperoleh disusun secara sistematis dan untuk selanjutnya analisis kualitatif dipakai untuk mencapai penjelasan yang dibahas. Dari hasil penelitian dengan metode diatas, penulis memperoleh jawaban atas permasalahan yang ada bahwa akibat hukum yang ditimbulkan atas akta wasiat yang dibuat di hadapan notaris dan yang tidak dilaporkan Pada Seksi Daftar Pusat Wasiat yaitu timbulnya kerugian terhadap pihak berkepentingan sebagaimana dimaksud dalam Pasal 84 UUJN Nomor 2 Tahun 2014 atas perubahan undangundang No.30 Tahun 2004 tentang Jabatan Notaris yaitu akta wasiat olografis yang tidak dilaporkan terdegradasi menjadi akta dibawah tangan dan akta wasiat terbuka yang tidak dilaporkan menjadi batal demi hukum. Dan bentuk pertanggungjawabannya adalah Sanksi bagi Notaris yang melanggar ketentuan Pasal 16 ayat (1) huruf i dikenakan sanksi Administrasi, sesuai Pasal 85 UUJN Nomor 2 Tahun 2014 atas perubahan Undang-undang Nomor 30 Tahun 2004 tentang Jabatan Notaris berupa: Teguran lisan, Teguran tertulis, Pemberhentian sementara, Pemberhentian dengan Hormat, atau Pemberhentian dengan tidak hormat. Selain itu Tanggungjawab Notaris terhadap akta wasiat yang dibuat di hadapan notaris dan yang tidak dilaporkan Pada Seksi Daftar Pusat Wasiat, Notaris dapat dimintakan pertanggungan jawaban perdata, sebagaimana maksud dalam Pasal 1365 KUHPerdata, yaitu tiap perbuatan melanggar Hukum, yang membawa kerugian kepada orang lain, mewajibkan orang yang karena salahnya menerbitkan kerugian itu, mengganti kerugian tersebut.

English Abstract

In this thesis, the author raised the issues related to the Notary's Responsibility for the Establishment of the Deed of Not Being Reported on the Section List of the Testament Center. The choice of theme is motivated by the negligence of Notary in the making of Deed of Wasiat which is not registered or not reported on the section of the center of the testament so as to have legal consequences. Based on the above, this paper raises the formulation of the problem: (1) How is the effect of the law resulted from the Deed made before a notary and that is not reported in the Section List of the Testament Center? (2) what is the responsibility of a notary on the creation of an unreported deed on the Center of Testament List? The method used in this research is normative law research with statute approach and case approach. The legal materials used include primary, secondary and tertiary legal materials, with the analysis of selected legal material is Juridical Analysis Ie analyzes based on theories and concepts and legislation. After that the data obtained is arranged systematically and for further qualitative analysis is used to achieve the explanations discussed. From the results of research with the above method, the authors obtain the answer to the existing problems that the legal consequences of the deeds made in the presence of notaries and which are not reported On the Section List of the Testament Center is the incidence of losses to interested parties as intended in Article 84 UUJN Number 2 Year 2014 for the amendment of Law No. 30 Year 2004 regarding Notary Position ie deed of olographic testament which is not reported to be degraded into the deed under the hand and the deed of open will is not reported to be null and void. And the form of responsibility is Sanction for Notary which violates the provision of Article 16 paragraph (1) letter i shall be imposed by Administration sanction according to Article 85 UUJN Number 2 Year 2014 on the amendment of Law Number 30 Year 2004 concerning Notary Position in the form of: Verbal Reprimand, Dismissal, Dismissal with Respect, or Dismissal with Disrespect. In addition, the responsibility of a Notary to a deed of a will made in the presence of a notary and which is not reported in the Section of the Register of the Testament Center, a Notary may be subject to civil liability, as intended in Article 1365 of the Civil Code, that is, any act of violation of the Law, bringing harm to others, The person who because of the wrong to issue the loss, compensate for the loss.
