Abstract
Akses peradilan adalah hak dasar yang harus dimiliki oleh setiap warga negara. Hak untuk memperoleh akses peradilan yang setara menjadi semakin krusial ketika warga negara tersebut adalah seorang penyandang disabilitas. Hak penyandang disabilitas untuk menikmati sistem peradilan yang inklusif tertuang dalam Convention on the Rights of Persons with Disabilities (CRPD) tahun 2006, dan diratifikasi oleh Pemerintah Indonesia melalui ditetapkannya Undang-Undang No. 19 tahun 2011 tentang Pengesehan CRPD. Akan tetapi, Penyandang disabilitas masih menemui hambatan dalam mengakses layanan peradilan, baik secara prosedur hukum, aksesibilitas peradilan maupun sikap prilaku penegak hukum terhadap penyandang disabilitas. Hal ini menjadi semakin memprihatinkan ketika banyak penyandang disabilitas rentan terlibat perkara hukum baik sebagai korban, pelaku/terdakwa dan saksi, yang menyebabkan akses mereka terhadap layanan peradilan yang inklusif menjadi penting. Organisasi Sasana Inklusi dan Gerakan Advokasi Difabel (SIGAB) yang berpusat di Daerah Istimewa Yogyakarta berupaya mendorong terciptanya lingkungan peradilan yang inklusif bagi penyandang disabilitas melalui program-program mereka di lapangan. Hingga saat ini, Organisasi SIGAB telah berupaya dalam menyediakan konsultasi dan pendampingan bagi penyandang disabilitas yang berhadapan dengan hukum, mengadvokasi produk hukum terkait isu disabilitas dalam lingkup peradilan, serta membangun relasi dengan aparatur hukum seperti kepolisian, kejaksaan maupun lembaga pengadilan untuk memberikan akses terhadap penyandang disabilitas. Adapun penelitian ini berupaya melihat peran SIGAB sebagai aktor non pemerintah dalam mendorong implementasi dari instrumen CRPD terkait akses peradilan bagi penyandang disabilitas, melalui pendekatan secara studi kasus, data wawancara, literatur terkait dan observasi secara partisipatoris di lapangan.
English Abstract
Access to justice is a basic form of human rights and all individuals is entitled to it. The right to enjoy the equal access to justice is even more critical especially for persons with disabilities. Persons with disabilities must be able to exercise their right to have a fair, inclusive and non-discriminatory access to the justice system. This right was reaffirmed through the declaration of the Convention on the Rights of Persons with Disabilities (CRPD) in 2006, and also has been ratified by many countries all around the world including Indonesia through the implementation of the law No. 19 2011 regarding the ratification of CRPD. How ever, despite all the laws that have been placed, persons with disabilities still encounter many barriers when accessing the justice system. These may include barriers like procedural barriers, lack of accesibilities and the poor attitude of law enforcement toward individuals with disabilities. On the other hand, Persons with disabilities tend to have a high probability to get involved in a crime, either as a victim or the person that commits the crime du to their vulnerability, which eventually makes their right to have an inclusive justice system is even more necessary. Sasana Inklusi dan Gerakan Advokasi Difabel (SIGAB) which is based in Special Region of Yogyakarta, is a non-governmental organization that aims to advocate for the inclusion of justice for persons with disabilities in Indonesia. Sigab arranges services such as providing legal assistant for persons with disabilities, advocating toward inclusive law and policy in the justice sector, and building networking with the police sector, attorneys, court officers and staff to help persowns with disability exercise their rights. This research aims to describe the roll of SIGAB Organization in supporting the CRPD implementation with regards to the access to justice for persons with disabilities at local level, by conducting case study approach, interview questions, book research and participant observation.
