Abstract
Dalam penelitian ini, penulis meneliti mengenai terjadinya peralihan hak atas tanah adat masyarakat tengger yang beralih kepada pihak luar bukan masyarakat tengger. Penelitian ini dilatarbelakangi karena terjadinya peralihan tanah adat yang sebenarnya tidak diperbolehkan untuk beralih kepada pihak luar terkait dengan ketentuan dalam hukum adat yang berlaku dalam kehidupan masyarakat tengger khususnya warga desa wonokitri. Hukum adat yang melarang untuk mengalihkan kepemilikan atas tanah adat ini mempercayai bahwa karma akan diberikan apabila aturan ini dilanggar. Peralihan tanah adat dalam masyarakat adat mewajibkan bahwa si kepala adat harus hadir sebagai saksi dan telah mendapatkan persetujuan dari masyarakat setempat, dikarenakan apabila peralihan tersebut dilakukan maka tanah adat yang mereka anggap sakral tidak akan menjadi milik adat melainkan milik pribadi pihak yang membeli. Namun, kejadian di masyarakat tengger khususnya di desa wonokitri bahwa peralihan tanah adat tersebut tidak dihadiri bahkan tidak diketahui baik oleh kepala adat serta warga desa wonokitri. Rumusan masalah dalam penelitian ini yaitu: (1) Mengapa ketentuan hukum adat tentang jual beli atas tanah adat masyarakat suku tengger kepada orang bukan suku tengger tidak dilaksanakan sesuai dengan ketentuan hukum adatnya? (2) Bagaimana upaya yang dilakukan masyarakat dan ketua adat dalam melakukan pelaksanaan ketentuan hukum adat masyarakat suku tengger tersebut? Metode penelitian ini memakai metode yuridis empiris dengan pendekatan perundang-undangan dan pendekatan kasus, yang menggunakan teknik analisis deskriptif untuk menganalisa data-data yang diperoleh dari lapangan untuk kemudian digunakan menjawab permasalahan yang ada. Hasil penelitian ini terdiri dari: (1) bahwa tidak dilaksanakannya ketentuan hukum adat ini dikarenakan faktor-faktor yaitu, yang bersangkutan sedanng membutuhkan biaya sehingga tanah adat tersebut dijual dan kurangnya pemahaman mengenai ketentuan adat membuat mereka tidak melibatkan kepala adat beserta masyarakat desa sekitar. (2) Upaya yang dilakukan untuk tetap menjaga agar ketentuan hukum adat tetap dilaksanakan yaitu : 1. Mensosialisasikan pengetahuan mengenai ketentuan-ketentuan adat dengan cara yang lebih unik dan menarik minat seluruh warga desa, 2. Mengajak generasi muda lebih ikut ambil bagian pada setiap upacara-upacara adat yang akan dilangsungkan, 3. Menyesuaikan beberapa ketentuan adat yang dapat diberikan sentuhan modern namun tidak menghilangkan kesakralan dan ciri khas dari hukum adat itu sendiri, dan 4. Mengikutsertakan beberapa ketentuan adat tertentu ke dalam peraturan tertulis jika dapat dilakukan.
English Abstract
In this research, the author examines the occurrence of the transition of rights to customary land of the Tengger community which shifts to outsiders rather than the tengger community. This research is motivated by the transition of customary land which is actually not allowed to switch to outside parties related to the provisions in customary law that apply in the life of the tengger community, especially the villagers of Wonokitri. Customary law that prohibits transfer of ownership of customary land believes that karma will be granted if this rule is violated. Transition of customary land in indigenous peoples requires that the customary head must be present as a witness and has obtained approval from the local community, because if the transition is carried out then the customary land that they consider sacred will not be the customary property but the private property of the buying party. However, the incident in the Tengger community, especially in the village of Wonokitri, was that the customary land was not even attended to by the head of the custom and the villagers of Wonokitri. The formulation of the problem are: (1) Why are the provisions of customary law regarding the purchase of customary land of the tengger tribe people to non-tengger tribes not implemented in accordance with the provisions of their customary law? (2) What are the efforts made by the community and customary leaders in carrying out the implementation of the provisions of the customary law of the Tengger tribe community? This research method uses an empirical juridical method with a statute approach and case approach, which uses descriptive analysis techniques to analyze data obtained from the field to then be used to answer existing problems. The results of this study consisted of: (1) that the non-implementation of the provisions of customary law is due to factors, namely, the person concerned who needs money so that the customary land is sold and the lack of understanding of the customary provisions makes them exclude the customary leader and the surrounding village community. (2) Efforts are made to keep the provisions of customary law in place, namely: 1. To socialize knowledge of customary provisions in a way that is more unique and attractive to all villagers, 2. Inviting more young people to take part in each ceremony - customary ceremonies to be held, 3. adjusting some customary provisions which can be given a modern touch but do not eliminate the sacredness and distinctive characteristics of the customary law itself, and 4. include certain customary provisions into written regulations if they can be done.
