Abstract
Penulis mengangkat permasalahan tentang Penerapan Kebijakan Yang Mewajibkan Seluruh Masyarakat Untuk Menjadi Peserta BPJS Ketenagakerjaan dan Peserta Dari Peralihan PT Jamsostek di Kantor BPJS Ketenagakerjaan Kota Madiun. Pilihan tema tersebut dilatarbelakangi banyaknya masyarakat khususnya pekerja yang belum melaksanakan kewajiban untuk menjadi peserta BPJS Ketenagakerjaan berdasarkan Pasal 14 Undang-Undang Nomor 24 Tahun 2011 Tentang Badan Penyelenggara Jaminan Sosial yang menyebabkan tidak baiknya penerapan peraturan pasal tersebut. Bedasarkan hal diatas, karya tulis ini mengangkat rumusan masalah : (1) Bagaimana penerapan kebijakan yang mewajibkan seluruh masyarakat untuk menjadi peserta BPJS Ketenagakerjaan dan peserta dari peralihan PT Jamsostek di wilayah Kota Madiun (2) Apa hambatan dan upaya dalam menerapkan kewajiban masyarakat untuk menjadi peserta BPJS Ketenagakerjaan dan juga peserta dari peralihan PT Jamsostek kepada BPJS Ketenagakerjaan di wilayah Kota Madiun? karya tulis ini menggunakan metode Empiris dengan metode pendekatan empiris sosiologis . Kantor BPJS Ketenagakerjaan cabang Kota Madiun di jadikan lokasi studi penelitian karena merupakan lembaga yang berwenang dalam pelaksanakan asuransi jaminan sosial untuk tenaga kerja di Indonesia. Data primer dan sekunder yang diperoleh Penulis akan diolah dengan teknik deskriptif kualitatif. Populasi dan sampel diperoleh dari petugas ataupun kepala staff bidang kepesertaan BPJS Ketenagakerjaan cabang Kota Madiun. Dari hasil penelitian dengan metode diatas, penulis memperoleh jawaban atas permasalahan yang ada bahwa penerapan terhadap diwajibkannya seluruh masyarakat khususnya tenaga kerja untuk menjadi peserta BPJS Ketenagakerjaan belum baik dalam pelaksanaannya, secara substansi hukum, penegakan dan pengawasan, sarana dan prasarana, dan masyarakat. Selain itu, BPJS Ketenagakerjaan Kota Madiun mengalami beberapa hambatan seperti subtansi peraturan perundang-undangan yang belum spesifik mengatur tentang kriteria peserta yang diwajibkan, kewenangan pengawasan dan penegakan sanksi, terbatasnya fasilitas sarana, rendahnya kesadaran masyarakat, dan sosialisasi yang tidak tersampaikan secara sempurna kepada masyarakat. Namun BPJS Ketenagakerjaan Kota Madiun telah melakukan berbagai upaya untuk mengatasi hambatan tersebut.
English Abstract
The author raises the issue of the Implementation of the Policy that Requires All Communities to Become BPJS Employees Participants and Participants from the Transition of PT Jamsostek at the BPJS Employment Office in Madiun City. The choice of the theme is motivated by the large number of people, especially workers who have not yet carried out the obligation to become BPJS Employment participants based on Article 14 of Law Number 24 of 2011 concerning the Social Security Organizing Agency which causes the improper application of the provisions of the article. Based on the above, this paper raises the formulation of the problem: (1) How is the application to the community who are required to become BPJS Employment participants and also participants from the transition of PT Jamsostek to BPJS Employment in the Madiun City area? (2) What are the obstacles and efforts in implementing community obligations to become BPJS Employment participants and also participants from the transition of PT Jamsostek to BPJS Employment in the City of Madiun area? Then the writing on this paper uses the Empirical method with the sociological empirical approach. The BPJS Employment Office in the Madiun City branch was made a research study location because it is an authorized institution in implementing social security insurance for workers in Indonesia. Primary and secondary data obtained by the author will be processed using qualitative descriptive techniques. The population and samples were obtained from officers or heads of staff in the BPJS Employment section of the Madiun City branch. From the results of the research with the above method, the author obtained an answer to the existing problems that the application of the entire community, especially workers, is required to be a participant in the BPJS. Labor is not good in its implementation, in substance law, enforcement and supervision, facilities andxvi infrastructure, and the community. In addition, the BPJS of the City of Labor in Madiun experienced several obstacles such as the substance of the legislation which had not yet specifically regulated the required participant criteria, the authority to supervise and enforce sanctions, the limited facilities, the lack of public awareness, and the socialization which was not conveyed perfectly to the public. However, BPJS Employment of Madiun City has made various efforts to overcome these obstacles.
