Abstract
Pasal 111 huruf C Angka 4 Peraturan Menteri Negara Agraria/ Kelapa Badan Pertanahan Nasional Nomor 3 Tahun 1997 Tentang Ketentuan Pelaksanaan Peraturan Pemerintah Nomor 24 Tahun 1997 Tentang Pendaftaran Tanah pihak yang berwenang dalam pembuatan Surat Keterangan Waris yaitu Notaris, Balai Harta Peninggalan, Kelurahan/Kecamatan. Surat Keterangan Waris dibuat oleh Kelurahan/Camat timbul permasalahan dalam pembuatannya, belum terdapat hukum positif yang jelas mengatur bagimana perlindungan hukum bagi Ahli Waris. Sehingga diketahui adanya aturan hukum yang tidak lengkap(Uncomplete Law). Penelitian menggunakan metode yuridis normatif dan menggunakan Teknik analisis interpretasi teleologis dan sistematis. Perlindungаn Hukum bаgi аhli wаris Golongаn Pribumi dаlаm pembuаtаn Surаt Keterаngаn Wаris tidаk sepernuhnyа tercаpаi. Hаl ini disebаbkаn belum аdа pengаturаn lebih lаnjut mengenаi ketentuаn аturаn hukum yаng berlаku (uncompleted norm), sehinggа diperlukаn regulаsi khusus yаng dаpаt menciptаkаn perlindungаn hukum bаgi аhli wаris Golongаn Pribumi. Bentuk Regulasi yang diperlukan yaitu Regulasi secara Subtantif berupa aturan khusus untuk kelurahan/kecamatan yang mengatur tentang pembuatan Surat Keterangan Waris yang dijabarkan lebih lanjut yaitu berupa Peraturan Pemerintah. Regulasi secara Procedural memuat siapa dan apa batasan bagi pihak yang berwenang dalam pembuatan Surat Keterangan Waris untuk golongan pribumi, Diperlukan juga tata cara adanya pengecekan terhadap ahli waris yang akan membuat Surat Keterangan Waris seperti pengecekan wasiat, prosedur mengajukan Surat Keterangan Waris dan pihak yang berkaitan dengan pewaris, ahli waris, dan harta warisan.
English Abstract
Based on Article 111 letter C Point 4 of Regulation of Agrarian Minister/Head of National Land Agency Number 3 of 1997 concerning Provisions of Implementation of Government Regulation Number 24 of 1997 concerning Land Registration, the authorised parties to make heir information document involve a notary, Heritage Hall, and Sub-district or District Head. However, the document issued by the sub-district/district has faced an issue, and there is no positive law regulating how an heir should be legally protected. Thus, this rule is still deemed an incomplete law. This study was conducted based on normative juridical method with teleological and systematic interpretations. Legal protection for the native people regarding the making of heir information document has not been fully achieved since there is no further regulation dealing with the provision of law that applies (incomplete norm). Therefore, a special regulation is required to legally protect native heirs. The regulation can be in the form of substantive one, involving special regulation for subdistrict/ district supervising the making of heir information document, which is further elaborated into government regulation. Procedural regulation can also be proposed, concerning the parties authorised and the extent of the authority in the making of the document for native people. The procedures are required to check the heir responsible for making the document, involving the supervision of the will, proposing heir information document, and parties such as a testator, an heir, and inheritance
