Abstract

Ada dua isu hukum yang dikaji dalam kekosongan norma mengenai kuasa menjual, yakni: (1) dasar Putusan hakim yang menolak permohonan kreditur dapatkah dibenarkan berdasarkan peraturan perundang-undangan yang berlaku (studi kasus Putusan Nomor 388 PK/Pdt/2014) (2) konsekuensi yuridis bagi para pihak bila kuasa menjual digunakan sebagai dasar pelunasan hutang (studi kasus Putusan Nomor 388 PK/Pdt/2014). Teori yang digunakan sebagai pisau analisis permasalahan yaitu teori perundang-undangan dan teori kepastian hukum. Metode yang digunakan dalam penelitian ini (1) tipe penelitian yuridis normatif (2) pendekatan penelitian ini menggunakan pendekatan perundangundangan dan pendekatan kasus (3) jenis bahan hukum primer yang digunakan: UU No. 4 Tаhun 1996 Tentаng Hаk Tаnggungаn (Pasal 1, Pasal 20), KUHPerdata Pasal 1313, 1320,1338, 1754, 1792, PP No. 24 tаhun 1997 Tentаng Pendаftаrаn Tаnаh (Pasal 32 ayat 2), Instruksi Mendаgri No. 14 Tаhun 1982 Tentаng Lаrаngаn Penggunааn Kuаsа Mutlаk Sebаgаi Pemindаhаn Hаk Аtаs Tаnаh, dan Putusаn Mаkаmаh Аgung Nomor 388 PK/Pdt/2014. Hasil dari penelitian menunjukan dengan terpenuhinya ketentuan Pasal 1792, 1813, 1338, 1320, KUHPerdata dalam kasus ini, maka dasar putusan hakim yang menolak permohonan kreditur, mengandung kekeliruan dalam penerapan hukum dan kuasa menjual yang digunakan para pihak sebagai dasar pelunasan hutang, merupakan bentuk jaminan kepastian hukum, maka secara yuridis jual beli tersebut adalah sah dan mempunyai kekuatan mengikat. Penulis berharap perlu adanya peraturan perundang-undangan yang mengatur secara jelas mengenai kuasa menjual sehingga para pihak dapat dilindungi hak-haknya.

English Abstract

There are two legal issues studied regarding the absence of norm of authority to sell: (1) can the decision made by a judge that rejects appeal by the creditor be accepted according to the Legislation (A case study on Decision Number 388 PK/Pdt/2014) (2) juridical consequence for all parties when the authority to sell serves as the basis to pay off debt (A case study on Decision Number 388 PK/Pdt/2014). The theories used in the analysis comprised legal certainty and statute theories. The methods involved normative juridical research which employed statute and case approaches, while the primary data was obtained from Act Number 4 of 1996 on Mortgage Rights (Article 1, Article 20), Civil Code Article 1313, 1320, 1338, 1754, 1792, Government Regulation Number 24 of 1997 on Land Registration (Article 32 Paragraph 2), Instruction of Minister of Home Affairs Number 14 of 1982 on Prohibition of Absolute Authority in Conveyance of Land Right, Decision of Supreme Court Number 388 PK/Pdt/2014. The research result indicates that when Article 1792, 1813, 1338, 1320 of Civil Code are fulfilled in this case, the decision made by Judges in which the appeal submitted by the creditor is rejected is regarded inappropriate in terms of legal implementation and authority to sell as the basis to pay off the debt. This fulfilment is also seen as legal certainty. As a result, juridically, the sale and purchase are seen valid and binding. It is essential that legislation clearly regulating authority to sell be made to protect the rights of the parties.
