Abstract
Pada tesis ini, penulis mengangkat permasalahan tentang implementasi program Landreform tentang pembatasan kepemilikan tanah pertanian untuk perorangan di Kabupaten Malang. Hal tersebut dilatarbelakangi adanya konflik sosial akibat dari pemilikan tanah yang tidak merata yaitu masih adanya kesenjangan sosial dan keberadaan tanah yang tidak bertambah sedangkan kebutuhan manusia akan tanah semakin meningkat seiring populasi penduduk semakin meningkat sehingga kesenjangan sosial antara pemilik tanah (tuan tanah) dan petani penggarap. Rumusan masalah tesis ini adalah bagaimana implementasi program landreform tentang pembatasan kepemilikan tanah pertanian untuk perorangan beserta hambatan dan solusi terhadap impelementasi program landreform tentang pembatasan kepemilikan tanah pertanian untuk perorangan di Kabupaten Malang. Tujuan dalam penelitian tesis ini adalah (1) untuk mendiskripsikan dan menganalisis implementasi Program LandReform tentang pembatasan kepemilikan tanah pertanian untuk perorangan di Kantor ATR/BPN Kabupaten Malang. (2) Untuk mendiskripsikan, menganalisis, dan menemukan hambatan Program LandReformtentang pembatasan kepemilikan tanah pertanian untuk perorangan di Kantor ATR/BPN Kabupaten Malang, dan (3) untuk mendiskripsikan, menganalisis serta menawarkan solusi terhadap hambatan Program LandReform tentang pembatasan kepemilikan tanah pertanian untuk perorangan di Kantor ATR/BPN Kabupaten Malang. Untuk menganalisis permasalahan tesis ini, teori-teori yang akan dijadikan pedoman analisis adalah teori negara kesejahteraan, teori efektivitas dan teori penguasaan dan kepemilikan tanah. Jenis penelitian tesis ini menggunakan metode hukum yuridis normatif dengan pendekatan yuridis sosiologis.. Hasil penelitian tesis ini, penulis menyimpulkan bahwa implementasi program landreform tentang pembatasan kepemilikan tanah pertanian untuk perorangan di Kabupaten Malang bеlum optimal, karena tidak teridentifikasinya tanah, adanya kepentingan dari berbagai pihak dan penyelundupan hukum, sehingga perlu ada sanksi yang tegas dan pasti baik berupa sanksi perdata maupun pidana, khususnya kepada oknum-oknum yang terlibat dalam upaya penyelundupan hukum yaitu pemilik tanah (pembeli sesungguhnya) dan pihak yang memberikan fasiltas pinjam namanya (nominee). Notaris/PPAT maupun PPATS dan Badan Pertanahan Nasional setiap terjadinya peralihan yang dilakukan oleh PPAT/Notaris maupun PPATS (Camat) hendaknya berkordinasi dengan Kantor Pertanahan setempat terkait pengalihan hak atas tanah. Masyarakat hendaknya untuk lebih berperan aktif serta mengawasi peralihan tanah dengan cara melaporkan kepada instansi-instansi terkait apabila terjadi praktek monopoli terhadap tanah pertanian.
English Abstract
In this thesis, the author raises the issue of the implementation of the Landreform program regarding restrictions on the ownership of agricultural land for individuals in Malang Regency . This was motivated by the existence of social conflict result from uneven land acquisition , namely the existence of social inequalities and the existence of land that did not increase while the human needs for land increased as population inflation increased, so that social inequality between landowners (landlords) and sharecroppers . The formulation of this thesis problem is how the implementation of restrictions the land reform program ownership of agricultural land for individuals along with obstacles and solutions toward the implementation of restrictions land reform programs ownership of agricultural land for individuals in Malang Regency . Purpose in this thesis are: (1) u ntuk describe and analyze the implementation of the Land Reform Program concerning restrictions on ownership of agricultural land for individuals in the ATR / BPN Office of Malang Regency . (2) To describe , analyze , and find obstacles to the LandReform Program regarding restrictions on ownership of agricultural land for individuals in the Malang Regency ATR / BPN Office , and (3) to describe, analyze and offer solutions to the barriers of the LandReform Program about restrictions on ownership of agricultural land for individuals in the ATR / BPN Office of Malang Regency. To analyzed the problem of this thesis, the theories are used as orientation analiysis is theory of welfare state , the theory of effectiveness and the theory of mastery and ownership land. This research is using normative juridis law with sociological juridical approach. The results of this thesis, the authors conclude that the implementation landreform program about restrictions on ownership of agricultural land for individuals in Malang Regency it’s not optimal, because there is no identification of land, the interests from various parties and law smuggling, it needs to be strict sanctionsand definite, either criminal or civil penalties. in particular for people who get involved in an effort law smuggling that is the ownership of land (the real buyer) and the party that give nominee. Notary / PPAT and PPATS and the national land authority office a transition is made by PPAT / Notary and PPATS (Camat) should coordinate with the local national land authority regarding the transfer of land rights. The society must act more actively and supervise the transfer of land by reporting to relevant agencies if there is a monopoly practice on agricultural land.
