Abstract
Penyerahan Protokol Notaris yang meninggal dunia berdasarkan Pasal 63 ayat 2 Undang-Undang Nomor 2 tahun 2014 tentang perubahan atas Undang-undang nomor 30 tahun 2004 tentang Jabatan Notaris menyebutkan dalam hal notaris meninggal dunia maka penyerahan protokol dilakukan ahli waris Notaris kepada Notaris lain yang ditunjuk oleh Majelis Pengawas Daerah. Pada kenyataannya dilapangan di Kota Malang ada beberapa kasus tidak diserahkannya protokol notaris yang meninggal dunia oleh ahli waris notaris. Apa akibat hukum bagi para pihak pembuat akta, jika ahli waris notaris tidak menyerahkan Protokol Notaris? Bagaimana Upaya Hukum Majelis Pengawas Daerah terhadap tidak diserahkannya Protokol Notaris ?. Metode penelitian yang digunakan adalah Yuridis Empiris yang menganalisi dan mengkaji bekerjanya hukum didalam masyarakat dengan menggunakan pendekatan Yuridis Sosiologis dan Antropologis. Berdasarkan hasil penelitian bahwa akibat hukumnya adalah 1) Menimbulkan kerugian bagi para pihak pembuat akta 2) ahli waris Notaris dapat di gugat secara perdata terkait kerugian yang dialami para pihak pembuat akta notaris 3) Akta Notaris tersebut harus dianggap sah sampai ada pihak yang menyatakan akta tersebut tidak sah dengan gugatan ke pengadilan umum sampai dengan adanya keputusan pengadilan yang mempunyai kekuatan hukum tetap (inkracht). Upaya hukumnya adalah. 1) Melakukan pencegahan dengan melakukan pendekatan dan sosialisasi terkait dengan kewajiban ahli waris untuk menyerahkan protokol notaris 2) Apabila ada para pihak yang dirugikan terhadap keberadaan protokol notaris untuk meminta salinan akta maka dapat melakukan upaya hukum juga dengan mengajukan gugatan ke Pengadilan 3) Pengawasan dan penindakan juga kepada notaris penerima protokol yang tidak mau menerima Protokol Notaris.
English Abstract
Submitting Protocol of a departed Notary is performed based on Article 63 Paragraph 2 of Act Number 2 of 2014 concerning Amendment of Act Number 30 of 2004 concerning Notarial Position, where the protocol should be submitted by the heir/heiress of the departed Notary to another Notary assigned by Regional Supervision Council. However, in several cases, the protocol is not submitted to an assigned notary, and it leads to legal consequences. This research is focused on the legal consequences and legal measures taken by the Regional Supervision Council over the notarial protocol not submitted, where empirical juridical research method along with socio-juridical and anthropological methods was employed, followed by an analysis and study of how the law works in society. The research result reveals that 1) failing to submit the protocol can cause loss to the party responsible to make the deed, 2) the heir/heiress of the Notary could be charged regarding the loss caused, and 3) the notarial deed must be deemed valid unless there is a party deeming invalid regarding the notarial deed by filing against the alleged to the court and by the court issuing legal decision regarding the issue with permanent legal force (inkracht). The legal measures that 1) can be taken involve approaches and encouragement of the submission of the notarial protocol. 2) When the approaches taken encounter some issues, filing against the alleged party to the court could be performed. 3) Supervision and further act towards the notary not willing to receive the protocol also need to be taken into account.
