Abstract
Notaris merupakan pembuat akta otentik yang sangat dibutuhkan dalam kehidupan bermasyarakat. Semakin tingginya jumlah peminat profresi notaris menjadikan munculnya norma hukum baru untuk menghasilkan notaris yang berkompeten dengan diadakannya ujian pengangkatan notaris sebagai syarat pengangkatan. Namun keberadaan peraturan tersebut dianggap praktik maladministrasi oleh para calon notaris Indonesia dan dianggap bertentangan dengan Undang-Undang Jabatan Notaris. Sehingga munculah konflik norma hukum antara peraturan hukum dan kemudian diajukannya judicial review. Konflik norma mengenai persyaratan pengangkatan notaris telah dibatalkan secara hukum dengan dikeluarkannya putusan hakim setelah dilakukan judicial review terhadap adanya persyaratan ujian pengangkatan notaris. Menggunakan metode penelitian yuridis normatif serta pendekatan undang-undang (statute approach) dan pendekatan historis (historical approach) penulis meneliti alasan pembentukan dan akibat hukum dari Putusan MA Nomor 50 P/HUM/2018 dalam pembatalan Permenkumham Nomor 25 Tahun 2017. Berdasarkan hasil penelitian dengan mengumpulkan data berupa fakta dan analisa kualitatif berdasar teori dan studi kepustakaan dapat dikatakan bahwa alasan Mahkamah Agung membatalkan perundangan yang mengatur ujian pengangkatan notaris terdiri dari alasan yuridis dan non yuridis, serta akibat hukum yang terjadi setelah dikeluarkannya putusan hakim yaitu terjadi kekosongan hukum setelahnya karena tidak memutuskan mengenai kejelasan aturan persyaratan pengangkatan notaris menjadi seperti apa sehingga calon notaris tidak dapat mengajukan pendaftaran pengangkatan notaris hingga saat ini.
English Abstract
Notary is an authentic deed maker that is needed in community life. The increasing number of notary profression enthusiasts makes the emergence of new legal norms to produce competent notaries by holding a notary appointment test as an appointment requirement. However, the existence of these regulations is considered to be the practice of maladministration by prospective Indonesian notaries and is considered to be contrary to the Act of Notary Position so that conflicts of legal norms emerged between legal regulations and then proposed judicial review. A norm conflict regarding the requirements for the appointment of a notary has been canceled legally by the issuance of a judge's decision after a judicial review of the notary appointment test requirements. Using normative juridical research methods and statute approaches and historical approaches, the author examines the reasons for the formation and legal consequences of the Supreme Court Decision Number 50 P / HUM / 2018 in the cancellation of Permenkumham Number 25 of 2017. Based on the results of the research with collecting data in the form of facts and qualitative analysis based on theory and literature studies can be said that the reason the Supreme Court overturned the laws governing the examination of notary appointments consisted of juridical and non-juridical reasons, as well as the legal consequences that occurred after the judge's decision was issued. regarding the clarity of the rules for the appointment of notaries to be what they are so that prospective notaries cannot submit a registration for notary appointments to date.
