Abstract
Salah satu bentuk kejahatan yang saat ini mengancam kehidupan bermasyarakat adalah tindak pidana narkotika. Bentuk-bentuk tindak pidana narkotika sendiri telah diatur pada Undang-Undang Republik Indonesia Nomor 35 Tahun 2009 tentang Narkotika yang dalam peraturan tersebut menerapkan 2 jenis sanksi yaitu sanksi tindakan dan sanksi pidana. Dalam Undang-Undang Republik Indonesia Nomor 35 Tahun 2009 tentang Narkotika tidak terdapat aturan yang menjelaskan tentang kedudukan antara sanksi tindakan dan sanksi pidana. Mengingat kompleksitas serta efek negatifnya, maka tindak pidana narkotika dikategorikan sebagai kejahatan luar biasa dan memerlukan upaya pemberantasan dengan metode atau klasifikasi yang luar biasa. Penelitian hukum ini mengkaji tentang rasio legis diterapkannya jenis sanksi terhadap peyalahguna narkotika bagi diri sendiri dan pecandu narkotika dalam Undang-Undang Republik Indonesia Nomor 35 Tahun 2009 tentang Narkotika dan penelitian hukum ini juga mengkaji perumusan kembali aturan tentang penjatuhan sanksi pidana dan sanksi tindakan. Karya tulis ini meggunakan metode dengan jenis penelitian yaitu penelitian hukum (normatif). Dengan menggunakan pendekatan kasus, pendekatan historis, pendekatan perundang-undangan, dan pendekatan konseptual. Penelitian hukum ini menghasilkan kesimpulan bahwa dalam penyusunan Undang-Undang Republik Indonesia Nomor 35 Tahun 2009 tentang Narkotika tidak dikaji secara komprehensif landasan diterapkannya double track system yang mengakibatkan kebingungan bagi penegak hukum untuk menindak atau memberikan hukum yang bermanfaat bagi pecandu narkotika sehingga kemudian menurut hemat penulis perlu dirumuskan kembali landasan di terapkannya sanksi pidana dan sanksi tindakan.
English Abstract
One form of crime that currently threatens social life is narcotics crime. The forms of narcotics crime itself have been regulated in the Law of the Republic of Indonesia Number 35 Year 2009 concerning Narcotics which in this regulation applies 2 types of sanctions namely sanctions and criminal sanctions. In the Law of the Republic of Indonesia Number 35 Year 2009 concerning Narcotics there are no rules that explain the position between sanctions and criminal sanctions. Given the complexity and negative effects, narcotics crime is categorized as an extraordinary crime and requires eradication efforts with extraordinary methods or classification. This legal research examines the legal ratios of the application of types of sanctions against narcotics abusers for themselves and narcotics addicts in the Law of the Republic of Indonesia Number 35 of 2009 concerning Narcotics and this legal research also examines the re-formulation of rules on imposing criminal sanctions and action sanctions. This paper uses a method with the type of research that is legal research (normative). By using a case approach, historical approach, statute approach, and conceptual approach. This legal research resulted in the conclusion that in the drafting of the Law of the Republic of Indonesia Number 35 Year 2009 regarding Narcotics not comprehensively studied the basis for the implementation of a double track system which causes confusion for law enforcement to act or provide useful law for narcotics addicts so that according to the opinion of the writer it is necessary reformulated the basis for the implementation of criminal sanctions and sanctions actions.
