Abstract
Penulis membahas tentang kedudukan hukum segel tanah sebagai alat bukti tertulis untuk pendaftaran tanah pertama kali. Banyaknya permasalahan terkait tumpang tindih kepemilikan atas lahan di Kota Balikpapan diakibatkan mudahnya masyarakat dalam membuat segel tanah sebagai bukti penguasaan fisik atas tanah dan pengantar untuk pengurusan sertifikat tanah. Jenis penelitian yang digunakan yaitu penelitian normatif dengan pendekatan perundang-undangan dan studi dokumen. Tujuan dari penelitian ini untuk mengetahui kedudukan hukum segel tanah setelah diterbitkannya peraturan daerah terkait IMTN sebagai pengganti segel tanah. Oleh karena itu pembahasan yang pertama terkait rasio legis diterbitkannya IMTN adalah Keputusan Presiden Nomor 34 Tahun 2003 tentang Kebijakan Nasional Di Bidang Pertanahan dalam hal ini Kepala Badan Pertanahan Nasional telah menerbitkan Keputusan Kepala Badan Pertanahan Nasional Nomor 2 Tahun 2003 tentang Norma dan Standar Mekanisme Ketatalaksanaan Kewenangan Pemerintah di Bidang Pertanahan”, berpedoman dari peraturan tersebut maka dikeluarkannya surat edaran nomor 591/2060/Perkot-Ptnh/2011 tentang Pemberitahuan Pemberlakuan Izin Membuka Tanah Negara oleh Walikota Balikpapan. Peraturan Daerah Nomor 1 Tahun Tahun 2014 tentang Izin Membuka Tanah Negara selaras atau sinkron dengan peraturan terkait penguasaan terhadap tanah negara serta pelimpahan kewenangan dari pemerintah pusat kepada pemerintah daerah dalam hal turut serta melaksanakan kegiatan pendaftaran tanah pertama kali. Selanjutnya yang kedua terkait kedudukan hukum segel tanah untuk pendaftaran tanah pertama kali telah ditertibkan oleh Surat Izin Membuka tanah Negara yang didasarkan pada Peraturan Daerah Nomor 1 Tahun 2014 tentang IMTN.
English Abstract
The author discusses the legal position of land seals as written evidence for the first land registration. The many problems related to overlapping ownership of land in Balikpapan City are due to the ease of the community in making land seals as proof of physical control of land and an introduction to the management of certificates of land rights. The type of research used is normative research with a legal approach and document study. The purpose of this study was to find out and analyze the legal position of land seals after the issuance of IMTN related regional regulations in lieu of land seals. Therefore, the first discussion concerning the logical ratio of IMTN issuance is Presidential Decree No. 34 of 2003 concerning National Policy in the Land Sector in this case the Head of the National Land Agency has issued a Decree of the Head of National Land Agency No. 2 of 2003 concerning Norms and Standards of Government Authority Management Mechanisms in the Land Sector, based on these regulations, the issuance of circular letter number 591/2060 / Perkot-Ptnh / 2011 concerning Notification of the Application of Permit for Opening State Land by the Mayor of Balikpapan. Regional Regulation Number 1 Year 2014 concerning Licensing to Open State Land is in harmony or synchronous with regulations relating to control of state land and delegation of authority from the central government to regional governments in terms of participating in the first land registration activities. Furthermore, the second one concerning the legal position of land seals for land registration for the first time has been regulated by a License to Open State land based on Regional Regulation No. 1 of 2014 concerning IMTN
