Abstract

Pada tesis ini membahas tentang kekosongan hukum terhadap pengaturan terkait salah satu kewenangan notaris, yakni cyber notary sebagaimana termaktub dalam Penjelasan Pasal 15 ayat (3) UU Jabatan Notaris. Dalam tesis ini mengangkat rumusan masalah: (1) Apa makna terhadap kewenangan notaris mengenai pembuatan akta melalui cyber notary? (2) Bagaimana implikasi hukum terhadap ketiadaan pengaturan hukum kewenangan Notaris dalam pembuatan akta melalui cyber notary? (3) Bagaimana formulasi pengaturan kewenangan notaris dalam pembuatan akta melalui cyber notary? Karya tulis tesis ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual dan komparatif. Bahan hukum primer, sekunder, dan tersier yang diperoleh penulis dianalisis dengan menggunakan teknik analisis preskriptif, yang kemudian ditafsirkan dengan menggunakan metode penafsiran bahasa, sistematis, serta komparatif. Pada hasil penelitian, penulis menemukan jawaban bahwa pemaknaan terhadap kewenangan Notaris mengenai cyber notary berlaku limitatif terhadap kewenangan mensertifikasi transaksi yang dilakukan secara elektronik. Implikasi hukum terhadap ketiadaan pengaturan hukum kewenangan Notaris dalam pembuatan akta melalui cyber notary dapat ditinjau dalam perspektif urgensi pengaturan cyber notary, manifestasi progresivitas hukum dalam bidang kenotariatan, serta kekosongan hukum terhadap kewenangan notaris dalam pembuatan akta melalui cyber notary. Sedangkan formulasi pengaturan kewenangan Notaris terhadap cyber notary meliputi mekanisme sertifikasi transaksi elektronik melalui cyber notary; akta cyber notary; wilayah jabatan notaris dalam cyber notary; dan kewajiban notaris dalam menjalankan kewenangan terhadap cyber notary.

English Abstract

This thesis discusses the absence of law that should regulate the authority held by a Notary Public as a cyber notary as enacted in Article 15 Paragraph (3) of Law on Notarial Post. Research problems are presented as follows: (1) what is the meaning that lies behind the Authority of a Notary Public to make deeds through cyber notary? (2) What is the legal implication regarding the absence of law that should regulate the authority held by a Notary Public to make deeds on cyber notary? (3) What formulation of regulation is required in regard to the Notary Public’s authority to make deeds on cyber notary? This research writing is considered as a normative legal law that used statute, conceptual, and comparative approaches, while the legal materials observed involved primary, secondary, and tertiary data, all of which were obtained and analysed by employing prescriptive analysis method, followed by language-based, comparative, and systematic interpretation techniques. The research result reveals that the authority held by the Notary Public to make a deed is only restricted to the authority to certify all electronic transactions. The legal implication of the absence of law that should regulate the authority of a Notary Public to make deeds on cyber notary could be seen from the perspective of urgency to regulate cyber notary, the manifestation of the progress of law in notarial law, and the absence of law that should regulate the authority of a Notary Public to make deeds on cyber notary. Moreover, the formulation of the regulation needed to regulate the authority of a Notary Public regarding the cyber notary involves electronic transaction certification mechanism on cyber notary; deed of cyber notary; the area in which the notary public serves in cyber notary; and the obligation of a Notary Public to perform his/her authority on cyber notary.
