Abstract
Pemberhentian Kepala Daerah dan Wakil Kepala Daerah ini diatur dalam Undang-Undang Nomor 32 Tahun 2004 Tentang Pemerintahan Daerah. Dalam pelaksanaan Peraturan Pemberhentian Kepala Daerah dan/atau Wakil Kepala Daerah belum menemukan bentuk yang jelas dan tegas, penerapannya dipengaruhi oleh konstelasi politik yang ada dalam setiap rezim pemerintahan untuk tujuan mendukung rezim yang berkuasa. Terbukti dengan adanya ketidakjelasan pemberhentian Kepala Daerah dan/atau Wakil Kepala Daerah oleh Mahkamah Agung dalam Pasal 29 ayat 2d dan 2e jo. Ayat 4 UU no.32 th.2004 Tentang pemerintahan daerah. Pemberhentian Kepala Daerah dan/atau Wakil Kepala Daerah terdapat dalam pasal 29 sampai dengan pasal 35 UU No. 32 Th.2004. Seorang Kepala Daerah hanya bisa diberhentikan apabila dinyatakan bersalah oleh keputusan pengadilan yang berkekuatan hukum tetap atau dinyatakan bersalah oleh Mahkamah Agung. Dari latar belakang tersebut timbul permasalahan yang hendak diteliti yaitu : Bagaimana pemberhentian Kepala Daerah dan/atau Wakil Kepala Daerah oleh Mahkamah Agung (berdasar pasal 29 ayat 2d dan 2e jo.ayat 4 UU No.32 Th.2004 tentang Pemerintahan Daerah). Dalam penulisan tesis ini, peneliltian yang dilakukan bersifat deskriptif yaitu cara penelitian yang menggambarkan secara lengkap dan jelas tentang persoalan yang diteliti dengan pendekatan yuridis normatif. Hasil penelitian menunjukkan bahwa : Pemberhentian Kepala Daerah dan/atau Wakil Kepala Daerah oleh MA berdasar pasal 29 ayat 2d dan 2e yo.ayat 4 UU No.32 th.2004 ini adalah tidak jelas atau kabur (vague norm).
English Abstract
The dismissal of the Regional Head and Deputy Regional Head shall be stipulated in Law Number 32 Year 2004 regarding Regional Government. In the implementation of the Regulation on the Dismissal of Regional Head and / or Deputy Regional Head has not found a clear and firm form, its application is influenced by the political constellation that exists in every regime for the purpose of supporting the regime in power. This is evidenced by the unclear dismissal of the Head of Region and / or Deputy Head of Region by the Supreme Court in Article 29 paragraph 2d and 2e jo. Paragraph 4 of Law no.32 th.2004 About local government. The dismissal of the Regional Head and / or Deputy Regional Head is contained in articles 29 to 35 of Law no. 32 Th.2004. A Regional Head can only be dismissed if found guilty by a court decision of permanent legal force or convicted by the Supreme Court. From the background, there are problems to be investigated, namely: "How to dismiss the Head of Region and / or Deputy Head of Region by the Supreme Court (based on Article 29 paragraph 2d and 2e jo.ayat 4 UU No.32 Thk2004 on Regional Government). In writing this thesis, the research conducted is descriptive that is the way of research that describes the complete and clear about the problem under study with normative juridical approach. The results show that: The dismissal of Head of Region and / or Deputy Head of Region by MA based on article 29 paragraph 2d and 2e yo.ayat 4 of Act No.32 th.2004 this is not clear or vague (vague norm).
