Abstract
Penelitian ini membahas tentang Rekonstruksi Perlindungan Hukum Terhadap Notaris Yang Beritikad Baik Dalam Kasus Tindak Pidana Pencucian Uang. Permasalahan yang dilalui oleh peneliti adalah menelaah mengenai gambaran atau upaya Rekonstruksi Perlindungan Hukum Terhadap Notaris yang menjadi korban atau pelapor dari kasus Tindak Pidana Pencucian Uang yang dilakukan oleh pengguna jasa terhadap Notaris, dengan tujuan untuk mengrekonstruksi upaya-upaya perlindungan hukum terhadap Notaris yang menjadi korban dalam kasus Tindak Pidana Pencucian Uang. Penelitian ini menggunakan jenis penelitian hukum yuridis normatife yang menggunakan metode pendekatan antara lain pendekatan perundang-undangan (statue approach), pendekatan konseptual (conceptual approach), Dari hasil analisis yang dilakukan maka dapat diketahui bahwa Perlindungan hukum kepada Notaris dalam hal tindak pidana pencucian uang menurut Undang-Undang Jabatan Notaris (UUJN) pada dasarnya lebih bersifat intern/administrative yaitu pada pasal 66 – 66A Undang-Undang Jabatan Notaris Nomor 2 Tahun 2014 Jo. Undang-Undang Nomor 20 Tahun 2004. Namun, selain itu Notaris juga mempunyai instrument lain sebagai bentuk perlindungan hukum dalam menjalankan tugas jabatannya berdasarkan Undang-Undang Jabatan Notaris (UUJN), yaitu Hak Ingkar (Verschoningsrecht). Konsep rekonstruksi perlindungan hukum terhadap Notaris dengan menambahkan ketentuan profesi secara jelas dalam kategori pihak pelapor sebagaimana yang telah ditentukan secara limitative oleh pasal 17 ayat 1 Undang-Undang Tindak Pidana Pencucian Uang (TPPU) Nomor 8 Tahun 2010. Sehingga tidak bertentangan dengan Pasal 16 ayat (1) huruf e Undang-undang No. 2 Tahun 2014 Tentang Undang-Undang Jabatan Notaris
English Abstract
This study discusses about the Reconstruction of Legal Protection for Notaries Whom Has Good ethics in the Cases of Money Laundering Crimes. These problems are passed by the researcher to analyse about the description or efforts to protect construction legal for Notaries whom becomes victims from Money Laundering Crimes cases that has been doing by the service users to the Notaries; the purpose to construction the efforts of legal protection for Notaries whom becomes victims in Money Laundering Crimes cases. This kind of research used normative legal research that use the oncoming method follows by: (statue approach), conceptual approach (conceptual approach), The analyses resulting that have done to known that legal protection to notaries in this case according to Lex of Notaries Constitution, basically tend to internal / administrative; Subsection 66 – 66A Lex of Notaries Constitution number 02 in 2014 junto Constitution number 20 in 2004. Nevertheless, Notaries have another instrument as legal protection pattern in undertaking the Lex Task based on Lex of Notaries Constitution, that is renegade (Verschoningsrecht). Reconstruction of Legal Protection concept for Notaries with determinate profession additional clearly in informant side have determined limitative by Subsection 17 clause 1 Criminal Offense of Money Laundering Constitution number 8 in 2010. So that it does not conflict with Article 16 paragraph (1) letter e of Law No. 2 of 2014 concerning the Act of Notary Position
