Abstract
Penelitian ini berfokus pada sengketa perdagangan internasional antara India dan Amerika Serikat. Amerika Serikat memberlakukan Countervaling Policy terhadap India atas produk ekspor dari India yaitu Hot Rolled Carbon Steel Flat pada tahun 2001 lalu dan berakhir pada tahun 2006. Namun setelah batas waktu yang ditentukan, Amerika Serikat belum juga menghentikan Countervailing Policy tersebut dan memberlakukan countervailing measures kepada India yang tidak sesuai dengan SCM Agreement yang harus disepakati semua negara yang bergabung dengan World Trade Organization atau WTO. Pada akhirnya India melaporkan Amerika Serikat ke WTO dan sengketa tersebut dibawa ke Dispute Settlement Body atau DSB. Rekomendasi dari DSB mengharuskan Amerika Serikat mengamandemen Tariff Act 1930 dan mematuhi segala proses yang ada dalam DSB. Namun Amerika melanggar dan tidak kunjung mengamandemen Tariff Act 1930 sehingga membuat India meminta compliance panel agar Amerika Serikat patuh. Ketidakpatuhan Amerika Serikat menjadi fokus penulis dalam penelitian ini. Ketidakpatuhan Amerika Serikat akan dijelaskan menggunakan Compliance Based Theory milik Andrew T Guzman dengan menggunakan dua variabel yaitu reputational loss dan direct sanctions. Penulis akan melihat cost and benefit dari sikap Amerika Serikat tersebut dan melihat besar kecilnya sanksi yang diterima.
English Abstract
This research focuses on international trade between India and the United States. The United States imposed a countervaling policy on India for export products from India, namely Hot Rolled Carbon Steel Flat in 2001 and ended in 2006. After a specified deadline, the United States has not also opposed countervailing policies and imposed countervailing measures for India that are not appropriate with the SCM Agreement which must be agreed by all countries joining the World Trade Organization or WTO. Eventually India reported the United States to the WTO and the dispute was sent to the Dispute Resolution Agency or DSB. Recommendations from the DSB require the United States to amend the Tariff Act 1930 and approve all processes in the DSB. But America refused and did not visit the Tariff Act 1930, so that made India request for compliance panels so that the United States would obey. United States Failure Become the focus of the author in this study. Failure The United States will use Andrew T Guzman's Compliance Theory Based on two variables: reputation loss and direct sanctions. The author will look at the costs and benefits of this United States attitude and see the size of the punishment received.
