Abstract
Negara mempunyai kewajiban untuk menyediakan layanan pengelolaan sumber daya alam bagi rakyat atau dalam penelitian ini khususnya sumber daya air. Sumber daya air atau air memegang peranan penting, air yang bersih sangat diperlukan dalam kesehatan dan kegiatan manusia tersebut. Namun masalah pemenuhan air bersih yang berkualitas masih menjadi masalah yang terus menerus terjadi di Indonesia, terdapat hambatan-hambatan yang menjadi kendala dalam layanan penyediaan air bersih khususnya oleh PDAM Kota Malang sebagai penyelenggara. Penelitian Hukum ini membahas tentang bagimana pelaksanaan kewajiban oleh PDAM dalam memberikan layayan air minum yang berkualitas yang penulis kaitkan dengan aturan Pasal 59 ayat (2) huruf a Peraturan Walikota Nomor 2 Tahun 2014 Tentang Pengembangan Sistem Penyediaan Air Minum sebagai norma yang berlaku. Dimana terdapat kendala atau hambatan pada PDAM Kota Malang yang menyebabkan norma yang penulis gunakan sebagai acuan tidak terselenggara dengan baik dan maksimal. Permasalahan yang hendak diangkat pada penelitian ini adalah; pertama, apa yang dihadapi oleh Perusahaan Daerah Air Minum (PDAM) Kota Malang dalam hal pelaksanaan kewajiban pemenuhan standar kualitas penyediaan air minum, dan kedua, bagaimana upaya yang telah dilakukan oleh Perusahaan Daerah Air Minum (PDAM) Kota Malang dalam menangani pemenuhan air bersih yang berkualitas. Untuk menjawab permasalahan tersebut peneliti menggunakan teori efektifitas Soerjono Soeknto yang nantinya peneliti kaitkan dengan pembahasan dalam menganalisa, dimana dalam teorinya Soerjono Soekanto membagi teori efektiftas ke dalam lima faktor yakni faktor hukum itu sendiri, penegak hukum, sarana atau fasilitas yang mendukung penegakan hukum, masyarakat, dan budaya hukum. Berdasarkan pembahasan, maka dapat disimpulkan : 1) Hambatan yang dihadapi oleh Perusahaan Daerah Air Minum (PDAM) Kota Malang dalam hal pelaksanaan kewajiban pemenuhan standar kualitas penyediaan air minum adalah terbatasnya faktor fasilitas atau sarana prasarana, yakni berupa keterbatasan peralatan dan bahan kimia (colagen) di laboratorium internal PDAM dan 2) Upaya yang telah dilakukan Perusahaan Daerah Air Minum (PDAM) Kota Malang dalam mengatasi pemenuhan air bersih yang berkualitas yakni dengan melakukan kerjasama antar daerah dalam suatu wilayah provinsi yang sama di dalam pengembangan sistem penyediaan air minum oleh Walikota sebagai Pemerintah Daerah, dimana di dalam kerjasama tersebut Pemerintah mengupayakan kerjasama terkait sistem fisik.
English Abstract
The state has an obligation to provide natural resource management services for the people or in this study specifically water resources. So that the water resources that are within the territory of the Indonesian State become the state's authority to manage them. Water resources or water plays an important role for the survival of living things on earth, especially for humans. Clean water is needed in these human health and activities. However, the problem of meeting the quality of clean water is still a problem that continues to occur in Indonesia, there are obstacles that become obstacles in the provision of clean water services, especially by PDAM Malang as the organizer. This Legal Research discusses how the implementation of obligations by the PDAM in providing quality drinking water services that the authors associate with the provisions of Article 59 paragraph (2) letter a Mayor Regulation Number 2 of 2014 concerning the Development of Drinking Water Supply Systems as an applicable norm. Where there are obstacles or obstacles in PDAM Malang City that causes the norms that the authors use as a reference are not implemented properly and optimally. Problems to be raised in this study are; first, what is faced by Malang City Water Supply Company (PDAM) in terms of carrying out the obligation to fulfill the quality standards for drinking water supply, and second, how the efforts made by Malang City Water Supply Company (PDAM) in handling the fulfillment of clean water supply quality. Toanswer this problem the researcher uses Soerjono Soeknto's effectiveness theory which the researcher later associates with the discussion in analyzing, in which Soerjono Soekanto's theory divides effectiveness theory into five factors namely the legal factor itself, law enforcement, facilities or facilities that support law enforcement, the public, and legal culture. Based on the discussion, it can be concluded: 1) Obstacles faced by Malang City Water Supply Company (PDAM) in terms of carrying out the obligation to fulfill drinking water quality standards is the limited factor of facilities or infrastructure, namely in the form of limited equipment and chemicals (collagen) in the PDAM's internal laboratory and 2) Efforts that have been made by the Municipal Drinking Water Company (PDAM) of Malang City in overcoming the fulfillment of high quality clean water by collaborating between regions within the same province in the development of drinking water supply systems by the Mayor as the Government Area. Where in the collaboration the Government seeks cooperation related to the physical system, which is the factor of infrastructure which is an obstacle in the implementation of the obligations of PDAM Malang.
