Abstract
Gerakan penghapusan hukuman mati telah menjadi tren global pada saat ini. Hal ini disebabkan hukuman mati dianggap melanggar hak asasi manusia yaitu hak untuk hidup dan tidak mempunyai tempat di abad ke-21. Gerakan penghapusan hukuman mati sudah dimulai sejak awal tahun 1960, pada perumusan Konvenan Internasional Hak-Hak Sipil dan Politik. Kemudian pada tahun 1988, dibentuklah Protokol Opsional Kedua Konvenan Internasional Hak-Hak Sipil dan Politik mengenai Penghapusan Hukuman Mati. Indonesia diberikan rekomendasi oleh Dewan HAM PBB saat sidang Universal Periodic Review pada tahun 2017 untuk meratifikasi protokol opsional kedua tersebut. Hal ini disebabkan eksekusi mati yang dilakukan oleh Indonesia pada tahun 2016 dan 2017 menuai kontroversi tidak hanya dari masyarakat domestik, namun juga masyarakat internasional. Namun meskipun ada tekanan dari level internasional dan level domestik, Indonesia menolak rekomendasi untuk peratifikasian Protokol Opsional Kedua Konvenan Hak-Hak Sipil dan Politik. Oleh karena itu, penelitian ini akan menggambarkan mengenai proses agenda setting yang terjadi pada proses perumusan Protokol Opsional Kedua Konvenan Hak-Hak Sipil dan Politik di Indonesia.
English Abstract
The abolition of the death penalty movement has been a global trend until now. Death penalty considered as a violation of human rights and has no place in 21st century. The movements started from early 1960s, while countries were drafting the International Covenant on Civil and Political Rights. Then on 1988, few countries started to draft the Second Optional Protocol to the International Covenant on Civil and Political Rights, aiming at the abolition of the death penalty. The United Nations Human Rights Council recommended Indonesia to ratify the Second Optional Protocol to the International Convention on Civil and Political Rights. This matter happened because Indonesia executed the prisoners on 2016 and 2017, drew controversy from domestic and international community. Aside the pressure from both domestic and international levels, Indonesia denied the recommendation to ratify the Second Optional Protocol to the International Convention on Civil and Political Rights. Therefore, this research will describe the agenda setting process that happened in Indonesia in 2017 to 2018 about the Second Optional Protocol to The International Covenant on Civil and Political Rights.
