Abstract
Usaha rumah kos merupakan salah satu usaha yang sudah lazim dan banyak pelaku usahanya di Indonesia, banyak pelaku usaha rumah kos di kota – kota besar seperti Jakarta, Bandung, Surabaya dan kota – kota lain di Indonesia. Kebanyakan usaha rumah kos atau sering disebut dengan kos-kosan berada di lingkungan tempat kerja misalnya kantor atau pabrik maupun di lingkungan tempat pendidikan seperti Perguruan tinggi. Usaha rumah kos memang sering ditemui di kota – kota besar di Indonesia namun bukan berarti di kota kecil tidak ada usaha rumah kos. Ponorogo merupakan salah satu contoh Kabupaten di Jawa Timur yang tidak terlalu besar namun masyarakatnya juga melakukan usaha rumah kos. Salah satu daerah di Ponorogo yang banyak pelaku usaha rumah kos ada di Kelurahan Ronowijayan dimana disana terdapat beberapa instansi pendidikan antara lain Universitas Muhammadiyah Ponorogo, Institut Agama Islam Negeri (IAIN) Ponorogo dan SMA N 1 Ponorogo. Seiring dengan maraknya usaha rumah kos yang ada di Kabupaten Ponorogo pemerintah membuat peraturan tentang usaha rumah kos yaitu Peraturan Daerah Kabupaten Ponorogo Nomor 1 Tahun 2016 tentang Ijin Usaha Rumah Kos. Walaupun peraturan tersebut telah di undangkan pada tahun 2016 dan dalam Pasal 9 ayat (1) telah mewajibkan para pelaku usaha rumah kos untuk memilili izin usaha rumah kos namun pada kenyataanya izin usah rumah kos hingga tahun 2018 masih 0 atau belum ada satupun usaha rumah kos di Kabupaten Ponorogo yang memiliki izin usaha rumah kos. Sehingga perlu ditelili tentang optimalisasi Pasal 9 ayat (1) Peraturan Daerah Kabupaten Ponorogo Nomor 1 Tahun 2016 tentang Ijin Usaha Rumah Kos. Penelitian ini menggunakan metode yuridis empiris yaitu dengan meniliti pelaksanaan Pasal 9 ayat (1) Peraturan Daerah Kabupaten Ponorogo tentang Ijin Usaha Rumah Kos di Kabupaten Ponorogo dengan data yang di peroleh dari Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu Kabupaten Ponorogo dan wawancara dengan pelaku usaha rumah kos yang ada di Kelurahan Ronowijayan Kabupaten Ponorogo. Dari hasil penelitian yang telah dilakukan dapat diketahui bahwa ada beberapa faktor yang menyebabkan tidak optimalnya penerapan Pasal 9 ayat (1) Peraturan Daerah Kabupaten Ponorogo tentang Ijin Usaha Rumah Kos antara lain: a). Faktor hukum, b). Faktor Penegak Hukum c). Faktor sarana dan fasilitas, d). Faktor masyarakat dan e). Faktor kebudayaan. Dari faktor-faktor diatas perlu adanya upaya antara lain: a). Sosialisasi, b) Perubahan Peraturan Daerah Nomor 1 Tahun Kabupaten Ponorogo tentang Ijin Usaha Rumah Kos dan c). Membuat peraturan baru agar penegakan izin usaha rumah kos di Kabupaten Ponorogo lebih Optimal.
English Abstract
Boarding house business is a common business and many business operators in Indonesia, many boarding house business actors in big cities such as Jakarta, Bandung, Surabaya and other cities in Indonesia. Most boarding house businesses or often referred to as boarding houses are in the workplace environment such as offices or factories as well as in educational environments such as universities. Boarding house businesses are often found in big cities in Indonesia, but that does not mean that there are no boarding houses in small cities. Ponorogo is one example of a district in East Java that is not too large but the community also runs a boarding house business. One area in Ponorogo that has many boarding house business actors in Ronowijayan Sub-District where there are several educational institutions including Muhammadiyah Ponorogo University, Ponorogo State Islamic Institute (IAIN) and Ponorogo N 1 High School. Along with the rise of boarding house businesses in Ponorogo Regency, the government made regulations regarding boarding house businesses, namely the Regional Regulation of Ponorogo Regency Number 1 of 2016 concerning Kos House Business Permits. Although the regulation has been issued in 2016 and in Article 9 paragraph (1) requires boarding house business operators to obtain boarding house business licenses but in fact the boarding house permit until 2018 is still 0 or there is not a single boarding house business in Ponorogo Regency, which owns a boarding house business permit. So it needs to be explored about the optimization of Article 9 paragraph (1) of the Regional Regulation of Ponorogo Regency Number 1 of 2016 concerning Business Permit for Kos Houses. This study uses an empirical juridical method that is by researching the implementation of Article 9 paragraph (1) of the Regional Regulation of Ponorogo Regency regarding the Business Permit for Kos Houses in Ponorogo Regency with data obtained from Ponorogo Regency One Stop Integrated Investment and Service Office and interviews with home business actors boarding house in Ronowijayan Village, Ponorogo Regency. From the results of the research that has been carried out, it can be seen that there are several factors that cause the optimal implementation of Article 9 paragraph (1) of the Regional Regulation of the Regency of Ponorogo concerning the Business Permit of a Kos House, including: a). Legal factors, b). Law Enforcement Factors c). Facilities and facilities factors, d). Community factors and e). Cultural factors. From the above factors, there needs to be an effort, including: a). Dissemination, b) Amendment to Regional Regulation Number 1 Year of Ponorogo Regency concerning Business Permit for Boarding Houses and c). Make new regulations so that enforcement of boarding house business permits in Ponorogo Regency is more optimum.
