Abstract

Pada penelitian ini, penulis mengangkat permasalahan mengenai kekurang lengkapan dan kurang jelas terkait pengaturan prinsip fair use terkait sarana kontrol teknologi hak cipta yang diatur dalam Undang-Undang Nomor 28 Tahun 2014 tentang hak cipta. Permasalahan ini dilatarbelakangi oleh pengaturan sarana kontrol teknologi untuk melindungi karya cipta yang diwajibkan oleh konvensi internasional WIPO Copyright Treaty kepada negara-negara pesertanya, dan bagaimana Analisis terkait pengaturan sarana kontrol teknologi apabila dikaitkan dengan prinsip fair use. Berdasarkan hal tersebut, rumusan masalah dalam skripsi ini adalah Bagaimana Analisis pengaturan prinsip fair use pada Pasal 44 ayat (1) Undang-Undang Nomor 28 Tahun 2014 apabila dikaitkan dengan pengaturan sarana kontrol teknologi dalam Pasal 52 Undang-Undang Nomor 28 Tahun 2014 ? dan bagaimana pengaturan hukum yang seharusnya tentang sarana kontrol teknologi hak cipta pada Undang-Undang Nomor 28 Tahun 2014 ? Untuk menjawab permasalahan diatas, penelitian hukum normatif ini menggunakan pendekatan perundang-undangan dan pendekatan komparatif. Bahan hukum yang digunakan dalam penelitian ini adalah bahan hukum primer dan sekunder yang diperoleh melalui studi kepustakaan dan media internet. Bahan hukum yang telah diperoleh , dianalisis menggunakan metode intepretasi gramatikal dan intepretasi sistematis sehingga dapat mengetahui penafsiran yang menafsirkan peraturan perundang-undangan dihubungkan dengan peraturan hukum atau undang-undang lain atau dengan keseluruhan sistem hukum. Berdasarkan pembahasan, diperoleh hasil bahwa kekurang lengkapan pengaturan prinsip fair use dalam pengaturan sarana kontrol teknologi. Sehingga dalam hal ini penulis memberikan rekomendasi berdasarkan peraturan hak cipta vii yang diatur dalam Canada Copyright Act yang sama-sama mengatur terkait sarana kontrol teknologi.

English Abstract

In this research, the author raises the problem regarding the regulatory principle of the fair use regarding the means of control of copyright technology that has not been regulated in the Law number 28 year 2014 about copyright that resulted in the void of law. This problem is backed by the arrangement of technological controls to protect the copyrighted work required by the WIPO International Convention Copyright Treaty to the participants ' countries, and how the analysis related to the arrangement of facilities Control technology when associated with the fair use principle. Based on this, the problem formulation in this thesis is how to analyze the principle of fair use in article 44 paragraph (1) of Law No. 28 year 2014 when associated with the arrangement of technological control means in article 52 of the Law Number 28 year 2014? And how is the recommendation of legal arrangements about the means to control copyright technology in the Law No. 28 of year 2014? To address the above problems, this normative legal research uses a comparative approach to legislation. The legal materials used in this study are primary, secondary, and tertiary legal materials obtained through literature studies and Internet media. The legal material that has been obtained, analyzed using grammatical method of grammatically and systematic interpretation so that it can be aware of interpretations that interpret the legislation associated with regulations or laws Or with the entire legal system. Based on the discussion, the results were obtained that the fair use principle setting has not been set in technological control settings, which resulted in the legal void. So in this case the author provides recommendations based on the copyright rules set out in the Canada Copyright Act which equally govern the means of technological control.
