Abstract
Hutan lindung RTK 15 Sekaroh merupakan hutan lindung yang terletak di Desa Sekaroh Kecamatan Jerowaru, Kabupaten Lombok Timur, Nusa Tenggara Barat. Penelitian ini bertujuan untuk melihat dan menganalisis kesalahan birokrasi lembaga pemerintah yang bersifat patoligis sehingga menimbulkan tindak pidana korupsi, dalam penelitian ini akan dibahas lebih lanjut mengenai tindakan penyalahgunaan dan Mismanagement. Penelitian ini dilakukan menggunakan metode kualitatif deskriptif untuk menjelaskan menjelaskan fakta dan fenomena terkait Mismanagement dalam lembaga pemerintah dalam penerbitan sertifikat hak milik atas tanah di hutan Sekaroh Kabupaten Lombok Timur, NTB. Penelitian ini dilakukan untuk meneliti faktor yang menyebabkan terjadinya penyalahgunaan wewenang dan Mismanagement BPN (Badan Pertanahan Nasional) dalam pengelolaan pertanahan hutan lindung Sekaroh. Hasil penelitian ini adalah terdapat beberapa praktik Mismanagement dalam menjalankan proses birokrasi adapun bentuk kesalahan tersebut adalah Ketidaktaatan akan Aturan Hukum, Penyalahgunaan Wewenang, minim Transparansi dan Akuntabilitas, Sabotase, Tindak Pidana Korupsi, dan okupasi lahan hutan lindung. Selain itu Hutan lindung Sekaroh sejak tahun 2002 sampai tahun 2017 banyak menuai kontroversi. Kontroversi ini didasari oleh perilaku aparat yang berwenang dalam kehutanan dan pertanahan tidak mampu menjalankan prosedur pemerintahan yang baik, adapun prosedur yang dilanggar adalah prosedur pengukuran tanah, penerbitan sertifikat di wilayah hutan lindung, dan ketidakjelasan status warga hutan lindung sekaroh.
English Abstract
RTK 15 Sekaroh protected forest is a protected forest located in Sekaroh Village, Jerowaru District, East Lombok Regency, West Nusa Tenggara. This study aims to see and analyze the bureaucratic mistakes of government institutions that are patoligical in nature so that it causes criminal acts of corruption, in this study will be discussed further regarding acts of misuse and mismanagement. This research was conducted using descriptive qualitative methods to explain the facts and phenomena related to mismanagement in government institutions in the issuance of land title certificates in the Sekaroh forest, East Lombok Regency, NTB. This research was conducted to examine the factors that cause abuse of authority and mismanagement of the National Land Agency (BPN) in the management of the Sekaroh protected forest land. The results of this study are that there are a number of Mismanagement practices in carrying out bureaucratic processes while the forms of error are Disobedience to the Rule of Law, Abuse of Authority, Minimal Transparency and Accountability, Sabotage, Corruption, and Occupational Protected Forest Land. In addition, the Sekaroh Protection Forest from 2002 to 2017 has caused a lot of controversy. This controversy is based on the behavior of the authorities in forestry and land is not able to carry out good governance procedures, while the procedures that are violated are land measurement procedures, issuance of certificates in protected forest areas, and unclear status of protected forest residents.
