Abstract
Penulis mengangkat permasalahan tentang Penerapan Pasal 8 Peraturan Kepala Badan Pertanahan Nasional Nomor 1 Tahun 2010 Tentang Standar Pelayanan Dan Pengaturan Pertanahan Terkait Pendaftaran Sertifikat Tanah. Pilihan tema tersebut dilatar belakangi karena dalam prosedur pembuatan sertifikat tanah dalam jangka waktu pembuatan sertifikat tanah tidak sesuai yang telah ditetapkan didalam pasal tersebut. Berdasarkan latar belakang tersebut di atas, maka permasalahan hukum yang dikemukakan dalam penelitian ini adalah : (1) Bagaimana penerapan Pasal 8 Peraturan Kepala Badan Peratanahan Nasional Nomor 1 Tahun 2010 tentang Standar Pelayanan dan Pengaturan Pertanahan terkait pendaftaran sertifikat tanah di Kabupaten Magetan ? (2) Apa saja faktor yang menghambat dalam penerapan Pasal 8 Peraturan Kepala Badan Peratanahan Nasional Nomor 1 Tahun 2010 tentang Standar Pelayanan dan Pengaturan Pertanahan terkait pendaftaran sertifikat tanah di Kabupaten Magetan ? (3) Apa solusinya agar tidak ada kendala dalam penerapan Pasal 8 Peraturan Kepala Badan Peratanahan Nasional Nomor 1 Tahun 2010 tentang Standar Pelayanan dan Pengaturan Pertanahan terkait pendaftaran sertifikat tanah di Kabupaten Magetan ? Kemudian untuk memjawab permasalahan di atas, penelitian menggunakan metode Yuridis Empiris yaitu jenis penelitian hukum sosiologis atau dengan melakukan penelitian lapangan. Pendekatan penelitian ini menggunakan pendekatan yuridis sosiologis. Kantor Badan Pertanahan Nasional yang menjadi lokasi studi penelitian karena merupakan lembaga yang berwenang untuk melakukan tempat untuk mendaftarkan tanah. Menggunakan data primer dan data sekunder yang diperoleh Penulis akan diolah dengan teknik Deskriptif Kualitatif. Populasi dan sampel diperoleh dari pegawai yang bekerja di dalam Badan Pertanahan Nasional Kabupaten Magetan. Berdasarkan pembahasan, maka dapet disimpulkan. Pasal 8 Peraturan Kepala Badan Peratanahan Nasional Nomor 1 Tahun 2010 tentang Standar Pelayanan dan Pengaturan Pertanahan terkait pendaftaran sertifikat tanah di Kabupaten Magetan xiv belum optimal dan belum berjalan dengan efektif. Jika dilihat dari fakta lapangan masih banyak sekali keluhan dari masyarakat Kabupaten jika melakukan pendaftaran sertifikat tanah. Kualitas dalam pelayanan menjadi salah satu yang menentukan, dalam praktek penyelenggaran pelayanan yang berkualitas dari birokat. Juga ada hambatan seperti : Medan tanah yang akan diukur, pengukuran tanah, kesadaran masyarakat kurang, kurangnya persyaratan yang harus dipenuhi atau dilengkapi pada saat akan melakukan pendaftaran sertifikat hak atas tanah, pajak, kurangnya sumber daya manusia atau staff. Dan untuk menghadapai solusinya, Kantor Badan Pertanahan Nasional di Kabupaten Magetan mengadakan sosialisai bersama masyarakat Kabupaten Magetan, melakukan penyuluhan hukum di kecamatan dan di kelurahan tepatnya di Kabupaten Magetan. Kegiatan ini bertujuan untuk memberikan pengetahun untuk masyarakat di Kabupaten Magetan tentang pendaftaran tanah, tata cara atau prosedur apa saja yang dibutuhkan saat untuk melakukan pendaftaran sertifikat tanah. Atau cara masyarakat Kabupaten Magetan untuk menghadapi sengketa tanah yang menjadi suatu masalah.
English Abstract
The author discusses the Application of Article 8 of the Regulation of the Head of the National Land Agency Number 1 of 2010 concerning Standard Services and Regulations on Land Related to the Registration of Land Certificates. The choice of the theme was motivated because in making land certificates within the period of making land certificates it was not as stated in the article. Based on the background above, the legal issues raised in this study are: (1) How is the application of Article 8 of the Regulation of the Head of the National Land Agency Number 1 of 2010 concerning Land Service and Regulatory Standards related to land certificate registration in Magetan Regency? (2) What are the factors that hinder the implementation of Article 8 of the Regulation of the Head of the National Land Agency No. 1 of 2010 concerning Land Service and Regulatory Standards related to the registration of land certificates in Magetan Regency? (3) What is the solution so that there are no obstacles in the application of Article 8 of the Regulation of the Head of the National Land Agency No. 1 of 2010 concerning Land Service and Regulatory Standards related to the registration of land certificates in Magetan Regency? Then to answer the problems above, the research uses the Juridical Empirical method, namely the type of sociological legal research or by conducting field research. This research approach uses a sociological juridical approach. The Office of the National Land Agency which is the location of the research study because it is an authorized institution to conduct a place to register land. Using primary data and secondary data obtained by the author will be processed with Qualitative Descriptive techniques. The population and samples were obtained from employees who worked in the Magetan Regency National Land Agency. Based on the discussion, it can be concluded. Article 8 of the Regulation of the Head of the National Land Agency No. 1 of 2010 concerning Land Service and Regulatory Standards related to the registration of land certificates in Magetan Regency has not been optimal and has not been effective. When viewed from the fact the field is still a lot of complaints from the people of the Regency if they register xvi land certificates. Quality in service is one of the determinants, in the practice of delivering quality services from bureaucrats. There are also obstacles such as: Medan land to be measured, land measurement, lack of community awareness, lack of requirements that must be fulfilled or completed when registering land rights certificates, taxes, lack of human resources or staff. And to face the solution, the Office of the National Land Agency in Magetan Regency held a socialization with the Magetan Regency community, conducted legal counseling in the sub-district and in the kelurahan precisely in Magetan Regency. This activity aims to provide knowledge for the people in Magetan Regency about land registration, what procedures or procedures are needed when registering land certificates. Or the way the people of Magetan Regency to deal with land disputes is a problem.
