Abstract
Penelitian ini bertujuan untuk mengetahui alasan Unit Laka Lantas Polres Malang Kota melakukan mediasi dalam menangani perkara kecelakaan lalu lintas Pasal 310 ayat (4) UU LLAJ, karena bedasarkan UU LLAJ penyelesaian perkara kecelakaan lalu lintas yang mengakibatkan matinya seseorang harus ditempuh melalui Sistem Peradilan Pidana, namun Unit Laka Lantas hampir secara keseluruhan melakukan penyelesaian perkara kecelakaan lalu lintas melalui mediasi, Tahun 2015-2018 sebanyak 829 perkara, lebih tinggi jika dibandingkan dengan jumlah perkara yang telah dinyatakan P21 dan dikeluarkan SP3 yaitu hanya sebanyak 125 perkara saja. Dalam penulisan skripsi ini, menggunakan metode yuridis empiris dan menggunakan pendekatan yuridis sosiologis. Teknik analisa yang digunakan adalah metode analisa dekriptif kualitatif. Dengan demikian ditemukan jawaban atas ketiga rumusan masalah, yaitu alasan penyidik melakukan mediasi, karena adanya diskresi kepolisian, Surat Kapolri No. Pol B/3022/XII/2009/Sdeops Tentang Penanganan Perkara Melalui ADR, Surat Telegram Kapolda Jatim No.ST/476/II/2010/Ditlantas, Surat Edaran Polri No.SE/8/VII/2018 Tentang Penerapan Keadilan Restoratif Dalam Penyelesaian Perkara Pidana, adanya kesepakatan damai, kecelakaan disebabkan kealpaan dan kecelakaan lalu lintas tidak merugikan kepentingan umum. Selain itu pula menjawab kendala dan upaya Unit Laka Lantas Polres Malang Kota dalam menerapkan Pasal Pasal 310 ayat (4) UU LLAJ.
English Abstract
This research aims to look into the mediation carried out by Traffic Accident Police of Sub-regional Police Department as an attempt to settle a dispute over road accident that causes death according to Article 310 Paragraph (4) of Act concerning Road Traffic and Transports (UU LLAJ), contrary to the Article implying that the case of deadly accident must be brought to court as it is seen as a crime. There were 829 cases from 2015-2018, the figure higher than that of cases considered as complete data obtained from the enquiry and that issued with SP3 (a letter issued to cease the enquiry). This research was conducted by employing empirical juridical method along with socio-juridical approach, followed by descriptive-qualitative-based method of analysis. The mediation was proposed since there was discretion in the police department. Moreover, this consideration also refers to the decree issued by the Head of National Indonesian Police (Kapolri) Number Pol B/3022/XII/2009/Sdeops concerning Case Settlement through ADR, Telegram of the Head of Regional police of East Java Number ST/476/II/2010/Ditlantas, Circular Letter of National Indonesian Police (Polri) Number SE/8/VII/2018 concerning Implementation of Restorative Justice in Criminal Case Settlement, agreement to reconcile, the condition where the accident was due to negligence not on purpose, and the condition where the accident does not violate common interests. This research is also expected to provide solution to the existing issues and measures taken by Traffic Accident Department of Sub-regional Police Department of Malang in terms of implementing Article 310 Paragraph (4) of UU LLAJ.
