Abstract

Pada skripsi ini penulis mengangkat permasalahan tentang Kewenangan Mengatur Suku Bunga Oleh Bank Indonesia Dalam Peer to Peer Lending. Pilihan tema tersebut dilatarbelakangi oleh tidak adanya peraturan mengenai batas penetapan suku bunga oleh BI terhadap industri teknologi finansial dalam hal ini ialah layanan Peer to Peer Lending. Penetapan suku bunga pada Peer to Peer Lending dianggap perlu agar pertumbuhan Peer to Peer Lending tetap memberikan ruang tumbuh bagi industri perbankan. Kewenangan BI dalam menetapkan suku bunga di industri perbankan merupakan kewenangan makro (macroprudential) yang dimiliki oleh BI selaku Bank Sentral di Indonesia sesuai Pasal 1 angka 10, Pasal 7, Pasal 8 huruf a dan b, serta Pasal 10 UU BI. Kewenangan tersebut semestinya berlaku pula terhadap penetapan suku bunga bagi industri teknologi finansial Peer to Peer Lending karena layanan ini menyalurkan kredit bagi masyarakat. Hingga saat ini, suku bunga Peer to Peer Lending masih menjadi kendali masing-masing Penyelenggara yang didasarkan Pasal 17 ayat (1) POJK Nomor 77/POJK.01/2016 tentang LPMUBTI. Sehingga untuk mencegah adanya ketimpangan dalam pemberian suku bunga antar Penyelenggara serta mempertahankan ekosistem ekonomi yang sehat, maka BI perlu mempertimbangkan penetapan regulasi bagi suku bunga pinjaman Peer to Peer Lending. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah sebagai berikut: Bagaimana kewenangan mengatur suku bunga oleh Bank Indonesia dalam Peer to Peer Lending. Karya tulis ini menggunakan metode penelitian yuridis normatif dengan metode pendekatan perundang-undangan (statute approach), pendekatan analisis (analytical approach), dan pendekatan konseptual (conceptual approach). Bahan hukum primer, sekunder dan tersier yang diperoleh oleh penulis akan dianalisis guna memperoleh jawaban atas rumusan masalah diatas. Hasil dari penelitian menunjukkan bahwa regulasi yang ada terkait dengan penyelenggaraan Peer to Peer Lending, masih belum memadai kebutuhan regulasi Peer to Peer Lending. Kewenangan BI dalam mengatur penyelenggaraan Peer to Peer Lending telah tertuang dalam Pasal 2 PBI Nomor 19/21/PBI/2017 tentang Penyelenggaraan Teknologi Finansial. Namun Pasal tersebut tidak menjelaskan secara eksplisit bahwa BI berwenang mengatur suku bunga Peer to Peer Lending. Sehingga makna mengatur pada Pasal tersebut tidak diketahui mencakup bidang apa dan hingga sejauh mana. Dengan mempertimbangkan dasar hukum dibentuknya PBI ini, maka apabila yang dimaksud mengatur pada Pasal tersebut mengacu pada tugas dan wewenang yang diberikan kepada BI sebagaimana tercantum dalam Pasal 1 angka 10, Pasal 7, Pasal 8 huruf a dan b serta Pasal 10 Undang-Undang Nomor 23 Tahun 1999 tentang Bank Indonesia, maka Pasal 2 PBI tentang Penyelenggaraan Teknologi Finansial tersebut merupakan dasar hukum bagi kewenangan BI dalam mengatur suku bunga Peer to Peer Lending.

English Abstract

In this thesis the author raises the issue of the authority to regulate interest rates by Bank Indonesia in Peer to Peer Lending. The choice of the theme was motivated by the absence of a regulation regarding the limits of interest rate determination by BI to the financial technology industry in this case the Peer to Peer Lending service. Determination of interest rates on Peer to Peer Lending is considered necessary so that the growth of Peer to Peer Lending continues to provide a growing space for the banking industry. BI's authority in setting interest rates in the banking industry is a macroprudential supervision owned by BI as the Central Bank in Indonesia in accordance with Article 1 number 10, Article 7, Article 8 letters a and b, and Article 10 of the BI Law. This authority should also apply to the determination of interest rates for the financial technology industry Peer to Peer Lending because these services provide credit to the community. Until now, the Peer to Peer Lending rate is still the control of each Operator based on Article 17 paragraph (1) POJK Number 77/ POJK.01/2016 concerning LPMUBTI. So as to prevent any imbalance in the provision of interest rates between Organizers and maintaining a healthy economic ecosystem, BI needs to consider setting regulations for interest rates on Peer to Peer Lending. Based on the above, this paper raises the formulation of the problem as follows: How is the authority to regulate interest rates by Bank Indonesia in Peer to Peer Lending. This thesis uses a normative juridical research method with a statute approach, an analytical approach, and a conceptual approach. Primary, secondary and tertiary legal materials obtained by the author will be analyzed in order to obtain answers to the above problem formulation. The results of the study indicate that the existing regulations relating to the implementation of Peer to Peer Lending, are still inadequate in the regulatory requirements of Peer to Peer Lending. The authority of BI in regulating the implementation of Peer to Peer Lending has been stated in Article 2 PBI Number 19/21/PBI/2017 concerning the Implementation of Financial Technology. However, the Article does not explicitly state that BI has the authority to regulate Peer to Peer Lending rates. So that the meaning of regulating the Article is not known to cover what field and to what extent. Taking into account the legal basis of the establishment of this PBI, then if the term set forth in the Article refers to the duties and authorities given to BI as stated in Article 1 number 10, Article 7, Article 8 letters a and b and Article 10 of Law Number 23 In 1999 concerning Bank Indonesia, Article 2 PBI concerning the Implementation of Financial Technology was a legal basis for the authority of BI in regulating Peer to Peer Lending rates.
