Abstract

Sengketa teritorial antara negara-negara Asia Tenggara dengan Republik Rakyat China atas kepemilikan wilayah perairan Laut China Selatan, merupakan salah satu isu internasional yang paling penting dalam beberapa tahun belakangan ini. Sengketa teritorial ini menjadi memanas ketika RRC memajukan klaim “nine dash line” nya Perserikatan Bangsa-Bangsa. Filipina, salah satu negara yang menolak klaim RRC di LCS, membawa sengketa teritorial tersebut ke Permanent Court of Arbitration. Pada tahun 2016, PCA berdasrkan UNCOLS memutuskan bahwa klaim “Nine Dash Line” RRC tidak memiliki dasar hukum, dan aktivitas RRC di LCS adalah suatu tindakan ilegal. Pemerintah RRC menolak hasil keputusan PCA tersbut. Penelitian ini bertujuan untuk mengetahui mengapa pemerintah RRC menolak hasil keputusan PCA tersebut. Hasil penelitian menunjukkan bahwa RRC menolak hasil keputusan PCA karena ada lebih banyak keuntungan yang dapat diterima RRC dengan menolak hasil keputusan tersebut.

English Abstract

The territorial dispute between Southeast Asian countries and the People's Republic of China over the territorial waters of the South China Sea, is one of the most important international issues in recent years. This territorial dispute is heating up when the PRC advances the claims of the nine dash line of the United Nations. The Philippines, one of the countries that rejected the PRC's claim to the LCS, brought the territorial dispute to the Permanent Court of Arbitration. In 2016, PCA based on UNCOLS decided that the PRC "Nine Dash Line" claim did not have a legal basis, and the PRC's activities in the LCS were illegal. The PRC government rejected the results of the PCA decision. This study aims to find out why the PRC government rejected the results of the PCA's decision. The results showed that the PRC rejected the results of the PCA decision because there were more benefits that the PRC could receive by rejecting the results of the decision.
