Abstract
Green Bond merupakan efek bersifat utang yang hasilnya ditujukan untuk mendukung pembiayaan proyek hijau. Green Bond diatur dalam Peraturan Otoritas Jasa Keuangan Nomor 60/OJK.04/2017 Tentang Penerbitan dan Persyaratan Efek Bersifat Utang Berwawasan Lingkungan (Green Bond). Namun, Indikator penilaian kelayakan proyek hijau tidak diatur secara jelas dalam POJK 60/OJK.04/2017. Berbeda dengan Indonesia, Republik Rakyat Tiongkok (RRT) telah memberikan pengaturan Green Bond yang detail dan lengkap. Berdasarkan latar belakang diatas, permasalahan hukum dalam penelitian ini adalah 1) Apa bentuk perlindungan hukum bagi investor Green Bond terhadap risiko Greenwashing dalam Peraturan Otoritas Jasa Keuangan Nomor 60/POJK.04/2017 Tentang Penerbitan dan Persyaratan Efek Bersifat Utang Berwawasan Lingkungan (Green Bond)? dan 2) Bagaimana perbandingan pengaturan Green Bond antara Indonesia dengan Republik Rakyat Tiongkok (RRT)?. Jenis penelitian yaitu penelitian hukum yuridis normatif. Metode pendekatan yang digunakan yaitu pendekatan peraturan perundang-undangan, dan pendekatan komparatif. Berdasarkan pembahasan dapat disimpulkan: 1) POJK 60/POJK.04/2017 kurang memberikan perlindungan hukum preventif bagi investor Green Bond terhadap risiko Greenwashing. Perlindungan hukum represif, merujuk Pasal 90 dan Pasal 104 Undang-Undang Nomor 8 Tahun 1995 tentang Pasar Modal, dan 2) Dibandingkan Indonesia, RRT memiliki pengaturan yang lebih detail dan lengkap dalam memberikan perlindungan hukum preventif bagi investor Green Bond terhadap risiko Greenwashing. Perlindungan hukum represif, RRT tidak mengatur secara khusus.
English Abstract
Green Bond is a debt securities which results are intended to support green project financing. Green Bond is regulated in the Financial Services Authority Regulation Number 60/OJK.04/2017 concerning the Issuance and Requirements of Debt Securities with Environmental Insights (Green Bond). However, the green project feasibility assessment indicators are not clearly stipulated in POJK 60 / OJK.04 /2017. Unlike Indonesia, the People's Republic of China (PRC) has provided detailed and complete Green Bond regulations. Based on the above background, legal issues in this study are 1) What forms of legal protection for Green Bond investors against the risk of Greenwashing in the Financial Services Authority Regulation Number 60/POJK.04/2017 concerning Issuance and Requirements for Debt Securities with Environmental Insight (Green Bond)? and 2) How does the Green Bond regulations compare between Indonesia and the People's Republic of China (PRC)?. This type of research is normative juridical legal research. The method of approach used is a statute approach, and a comparative approach. Based on the discussion it can be concluded: 1) POJK 60/ POJK.04 /2017 lacks preventive legal protection for Green Bond investors against the risk of Greenwashing. Repressive legal protection, referring to Article 90 and Article 104 of Act Number 8 of 1995 concerning Capital Market, and 2) Compared to Indonesia, the PRC has a more detailed and complete regulations in providing preventive legal protection for Green Bond investors against the risk of Greenwashing. Repressive legal protection, China does not regulate specifically.
