Abstract
Pada skripsi ini, peneliti mengangkat permasalahan tentang perlindungan khusus anak korban pencabulan dalam lingkup rumah tangga. Pilihan tema tersebut dilatar belakangi karena kasus pencabulan anak yang terjadi di kota Bekasi terus meningkat setiap tahunnya, sehingga penulis meneliti di Polres Metro Bekasi tentang kendala yang dihadapi dalam memberikan perlindungan khusus untuk memenuhi hak-hak anak korban pencabulan tersebut yang sesuai dengan Undang-Undang. Berdasarkan hal tersebut penulis mengangkat rumusan masalah: (1) Bagaimanakah bentuk pelaksanaanperlindungan khusus terhadap anak korban pencabulan dalam lingkup rumah tangga yang dilakukan oleh Polres Kota Bekasi? (2) Apa kendala yang dihadapi oleh Polres Metro Kota Bekasi dalam pelaksanaan perlindungan khusus anak korban pencabulan dalam lingkup rumah tangga dan bagaimana upaya dalam menghadapi kendala tersebut ? Penelitian yang digunakan dalam penelitian ini adalah penelitian empiris. Dengan menggunakan metode pendekatan yuridis sosiologis. Penelitian ini di laksanakan di Kepolisian Resort Metro Kota Bekasi, Jawa Barat. Teknik memperoleh data dengan melakukan wawancara, pengumpulan data dengan cara mencatat dokumen yang berkaitan dengan masalah yang diteliti dan dilakukan dengan menganalisis permasalahan berdasarkan teori-teori yang dapat digunakan sebagai pedoman. Kemudian teknik analisa data dengan teknik deskriptif analisis. Bentuk perlaksanaan perlindungan Khusus yang diberikan oleh Unit Pelayanan Perempuan dan Anak Polres Metro Kota Bekasi terhadap anak korban pencabulan dalam lingkup rumah tangga belum sepenuhnya sesuai dengan Undang-Undang yang menjadi dasar untuk memberikan perlindungan khusus terhadap anak korban pencabulan dalam rumah tangga. Seharusnya pihak kepolisian lebih memperhatikan lagi undang – undang yang digunakan dalam memberikan perlindungan anak korban pencabulan dalam lingkup rumah tangga agar hak-hak anak korban pencabulan dapat terpenuhi. Serta berbagai kendala antara lain, belum tersedianya ruangan khsusus yang digunakan untuk anak korban pencabulan dalam memberikan keterangan yang dialami oleh si anak korban, unit PPA belum memiliki seseorang yang kompeten dalam memberikan bimbingan konseling mengenai mental yang tidak stabil anak korban pencabulan, dan dari korban sendiri menolak untuk melanjutkan laporanya, dengan alasan trauma dan takut adanya ancaman dari keluarga.
English Abstract
This study discussed, the researcher raised the issue of the special protection of children affected by sexual abuse within the household. The choice of the theme was motivated by the many cases of child molestation that occurred in the city of Bekasi while the perpetrators themselves were the closest people to the victims, so the authors examined the Resort Police City of Metro City Bekasi about the obstacles faced in providing special protection to fulfill the rights of child victims of sexual abuse in accordance with Applicable law. Based on this, the author raised the formulation of the problem: (1) How is the form of implementation of special protection for child victims of molestation in the scope of the household carried out by the Resort Police City of Metro City Bekasi? (2) What are the obstacles faced by the Resort Police City of Metro City Bekasi in the implementation of special protection for child victims of sexual abuse within the household and how are the efforts to deal with these obstacles? The research used in this study is empirical research. By using a sociological juridical approach. This research was carried out at the Resort Police City of Bekasi, West Java. The technique of obtaining data is by conducting interviews, collecting data by recording documents relating to the problem under study and carried out by analyzing problems based on theories that can be used as guidelines. Then analyze with descriptive analysis techniques. The form of Special protection provided by the Bekasi City Police Metro Station Women's and Children's Service Unit for child victims of sexual abuse in the household scope is not fully in accordance with the Law which is the basis for providing special protection for child victims of sexual abuse in the household. The police should pay more attention to the law used in providing protection for child victims of abuse in the household so that the rights of child victims of sexual abuse can be fulfilled. As well as various obstacles, among others, the unavailability of special rooms used for child victims of sexual abuse in giving information experienced by the child victims, the Women's Protection Unit and the child does not yet have someone who is competent in providing counseling regarding unstable mental child abuse victims, and from the victim himself refused to continue his report, citing trauma and fear of threats from the family.
