Abstract
Perkembangan hukum, baik pada skala nasional maupun global, dipengaruhi oleh perkembangan sains dan teknologi. Teknologi baru artinya munculnya persoalan-persoalan baru. Sedangkan hukum yang ada dianggap masih belum mampu mengatasi persoalan-persoalan tersebut. Program komputer adalah salah satu dari sekian banyak hal yang dilindungi oleh hukum hak cipta. Penelitian hukum ini membahas tentang “desain cleanroom” yang termuat pada perkara pada 2018 yang melibatkan dua raksasa, Oracle dan Google, sebagai bukti atas sebuah persoalan dalam perlindungan hak cipta, khususnya pada program komputer . Dari latar belakang tersebut, permasalahan yang hendak diangkat pada penilitian ini adalah; pertama, menurut Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta (UUHC), apakah desain cleanroom pada program komputer termasuk dalam pengecualian prinsip fair use, dan kedua, apakah akibat hukum dari desain cleanroom pada program komputer menurut UUHC. Untuk menjawab permasalahan tersebut, penelitian hukum normatif ini menggunakan pendakatan perundang-undangan, pendekatan kasus, dan pendekatan perbandingan. Bahan hukum yang berhubungan dengan masalah yang diteliti diperoleh melalui penelusuran kepustakaan dan pendapat para ahli. Bahan-bahan hukum yang telah diperoleh dianilisis dengan menggunakan metode interpretasi gramatikal dan metode komparatif sehingga dapat disajikan dalam penulisan yang lebih sistematis guna menjawab isu hukum yang telah dirumuskan. Berdasarkan pembahasan, maka dapat disimpulkan: 1) desain cleanroom termasuk dalam pengecualian fair use sehingga penggunaan di luar fair use adalah bertentangan dengan UUHC, dan 2) akibat hukum dari penggunaan desain cleanroom yang tidak digunakan berdasarkan fair use terhadap perjanjian lisensi program komputer yang menjadi dasar.
English Abstract
The development of law, either at national or global level, is affected by the growing science and technology, where new technology development is undoubtedly followed by fresh issues. The existing law, however, is not seen capable of tackling the issues. Computer program is one of many that are protected under copyright law. This legal research discusses cleanroom design as in the case that took place in 2018, involving two giant companies Oracle and Google. This case serves as evidence concerning the copyright protection especially for computer program. The issues mentioned earlier have brought this research to the following problems: is the cleanroom design on computer program, as in Act Number 28 of 2014, excluded from the principle of fair use? and what legal implications are caused by the case of cleanroom design on computer program according to Act of Copyright? This normative-legal research employed statute, case, and comparative approaches, and the legal materials were obtained from literature studies and notions from experts. All the data obtained was analysed with grammatical interpretation and comparative method for more systematic writing to clearly answer the problems discussed in this research. This research concludes that: 1) cleanroom design is included in the exception of fair use and any use outside the context of fair use is against the Act of Copyright, and 2) the legal consequence is used as the basis regarding the design of cleanroom used according to the principle of fair use in regard to licence agreement of computer program.
