Abstract
Penelitian ini menjelaskan penyebab yang membuat Uni Eropa melakukan pelanggaran dalam penerapan bea masuk anti-dumping produk biodiesel kelapa sawit Indonesia tahun 2013 hingga 2018. Uni Eropa sebelumnya telah meratifikasi Anti-Dumping Agreement GATT 1994 dan regulasi tersebut telah disepakati dan diratifikasi oleh negara-negara anggota WTO lainnya. Anti-Dumping sebenarnya diperbolehkan untuk dikenakan dalam perdagangan internasional antara negara anggota WTO selama memenuhi aturan yang berlaku dengan measurement yang tepat. Penelitian ini dijelaskan dengan menggunakan teori Compliance dan Non-Compliance oleh Abram Chayes dan Antonia Chayes. Berdasarkan penelitian ini, penulis mendapatkan bahwa faktor yang memengaruhi ketidakpatuhan Uni Eropa terhadap Anti-Dumping Agreement GATT 1994 dalam kasus produk biodiesel Indonesia adalah kebijakan domestik Uni Eropa berupa EU-RED yang berimplikasi terhadap tindakan ketidakpatuhan tersebut serta kebijakan tersebut bersifat diskriminatif. Melalui penelitian ini, penulis melihat adanya upaya Uni Eropa dalam memproteksi produksi biodiesel domestiknya untuk mendorong perekonomian dari sektor renewable energy.
English Abstract
This research examines the factors of the European Union’s violation in implementing Anti-Dumping duty to biodiesel palm oil product from Indonesia on 2013 to 2018. Previously, EU has ratified Anti-Dumping Agreement GATT 1994 and this regulation has agreed and ratified by other WTO member countries. Anti-Dumping is actually permitted to be implemented in international trade affairs between WTO members as long as it is completing the prevailed regulation with appropriate measurements. This research is explaining the case using Compliance and Non-Compliance theory from Abram Chayes and Antonia Chayes. The result of this research shows that the factors that caused EU’s violation to Anti-Dumping Agreement GATT 1994 is the domestic policy of the EU, which is EU-RED. The EU-RED is affecting the non-compliance act of the EU because this is a discriminative policy. Through this research, the EU seemed to protect its domestic biodiesel production to increase their economic growth from renewable energy sector.
